This is a continuation of my previous post The Ripple Effect. I dedicate this post to CV -- a kind-hearted man who will no longer have the opportunity to give his side of the story.  My original intention in writing this post was to act as CV's voice and clear his name as this chapter of his life closed. Out of respect to him and his family, I waited enough time to write anything about this and have kept his name and details of the events confidential.

I firmly believe that Alfieri falsely accused CV of physical assault. How do I know the accusation was false? Did I witness this incident? No, I was not there and was not a witness. So how can I claim that Alfieri made a false accusation?

Well, let's not forget that Alfieri shamelessly accused me of theft and slander while he was the one who defrauded and defamed me.  It does not surprise me that he would make stories about others. Just a month or two after he sued me in September 2011, he filed a harassment order against the former co-director/editor of "Looking for Clarissa" claiming she tried to push his Porsche off the road while driving at high speed on Santa Monica Blvd (Century City/Beverly Hills area). First of all, when can anyone drive fast on Santa Monica Blvd in that area of town? Second, he was the one who was driving the Porsche, wasn't he? And the most recent legal claim made by Alfieri that I am aware of was against his own Homeowners Association. I was told that Alfieri lost that lawsuit.

It is clear to me that Alfieri feels that he can use the "law" to try to intimidate or get money from the opposing party.  The problem here is that Alfieri uses outrageous untrue allegations to build "his case." These stories built on ridiculous lies eventually collapse.

It is true that I am still dealing with Alfieri and his unwillingness to take responsibility for what he has done. But my case is only a civil matter. What CV had to face were criminal charges that could have potentially meant time in jail. Although CV was clearly innocent, it is undeniable that he was scared and stressed as he awaited his trial.

I really do not want to get into specifics about what happened between CV and Alfieri. It does not really matter any more.  All I need to say is that CV was not aggressive or confrontational. On the contrary, he would always offer a smile to everyone with whom he interacted. CV was someone who saw the good in people and believed in generosity and forgiveness.  He did not assault Alfieri, nor did he want to continue having any conflict with him.

There was an opportunity to settle the case without going to trial. CV happily accepted the opportunity while Alfieri had the audacity to add even more fabricated lies to his previous version of the facts.

All CV wanted was to make peace, as he said to me, he just wanted to shake Victor's hand, be cordial to each other... and live in harmony.



It is unfortunate that the unfair stress to which he was subjected was what eventually took a toll on his health. He developed an ulcer that led him to the Emergency Room. The next morning, he passed away.

Our words, actions... even our thoughts and intentions touch everyone around us -- EVERYONE --  especially those who are targeted as recipients of such words, actions or thoughts.

Let's live with awareness and treat others with respect, compassion and kindness. We are mirrors of one another. What we give, we receive.  Let's choose peace over war and conflict... And let's first make peace with ourselves so we can extend it to everyone else.

May CV's soul rest in peace. His memory and spirit will remain with us forever.

This morning I was walking by the Coffee Bean on Sunset Blvd., I thought of Victor Alfieri and how funny it would be to run into him there. I even imagined cheerfully shouting out "Alfieri" with a big smile on my face.... when a man twirling his hair got my attention...

This man was compulsively twirling the hair that was sticking out of the bandana he was wearing over his head. This is something Victor would do all the time. I remember I would slap his hand when he did  that and would say, "stop doing that!" because it truly got on my nerves.

When I got closer to him, I observed, his face, his profile, his clothes.... It was Victor Alfieri!!! I think he also saw me but pretended he did not know who I was. He immediately put his headpiece (connected to his cell phone) in his ear and started walking the opposite direction.

Larrabee Street

Last year, I was living in an apartment on Larrabee and Santa Monica Blvd. He knew I lived on Larrabee because I had told him I moved there.  This is before we broke up and, of course, before the scandal erupted. However, he did not know the exact address. Please see map on left. "A" is where I used to live.

After publicly accusing me of being obsessed with him and of "stalking" him, I found him following me and driving by my apartment building several times.  Anyone from West Hollywood knows that Larrabee is only 3 blocks long. There is really NO reason to drive on Larrabee if you don't live there or if you are not visiting someone who lives there. San Vicente Blvd, a major street, is just a block away from Larrabee Street and can connect you to Santa Monica Blvd or Sunset Blvd.

It was clear that he wanted to know where my apartment was and spent numerous hours driving down the short 3 block street trying to figure out where EXACTLY I lived. I remember one day as I was exiting my garage, I cut off a car that I was approaching. I waved at the car with an apologetic gesture. I realized it was Victor's Porsche... with Victor inside. Because he was right behind my car, I could see him in my rear view mirror. We were both heading toward Santa Monica Blvd. We were going to have to make a right turn. But, through the rear view mirror, I saw how Victor freaked out and made an immediate left into an alley. At that point, he had succeeded in finding out where I lived.

Just a couple of weeks after this incident, a mutual friend who was visiting me saw him on the corner of Cynthia and Larrabee. I actually met this mutual friend through Victor, himself. He also had problems with her and they were not talking anymore. He was again in his Porsche signaling that he was going to turn right onto Larrabee Street, my block - and as I said before - really no reason to go that way. He saw my friend and "freaked"... What did he do this time?  He continued going straight on Cynthia with his right blinker still on!

Why would he drive by my place???? What was he expecting to get out of it??? Was he spying on me?  So who was stalking whom?

When he and I started talking again after I dropped my lawsuit against him, he was very persistent in getting my new address. He claimed he would send a copy of the first cut of the film by regular mail. I refused to give my home address to him although by now, he probably knows it. He proved to be a good investigator.

It is really ironic how close the two of us are geographically. Next time we run into each other, I hope to be able to say hello and communicate like two adults. He is the one who started all the conflict. He is the one who created a slanderous lie about me that grew too big to be manageable. If he offered his sincere apologies and told the truth about what really happened between us.... Well.... I could only dream!!!!

The Most Creative and Memorable 

Claims Made by Alfieri

10 - He does not mix business with pleasure.

He constantly claims that he is very professional and respectful. He also claims that he does not mix business with pleasure when he gets the investors' money by sleeping with them.

9 - He had very professional disputes. 

This is just a funny quote by him - "very professional" disputes. It is simply memorable.

8 - He likes to make sexual jokes because he is Italian.

When he was asked if he ever made sexual comments on set he said NO. Then he admitted to asking Clark J. Gable to bend over in order to get more lines. He also admitted to telling Nicole Sienna to give him hugs to get more lines. He claimed that he was joking... but that is what sexual harassment is! He justified his sexual jokes by saying:

"I am Italian. That's the way we joke. And I like to joke like that." 

7 - His house in Italy - he doesn't own it legally... but it is his!

He had told me (and many other people) that he owned both his house and his mother's house in Italy. He told me he paid CASH for them. He owned them free and clear. During his deposition he claimed that his house in Italy belonged to a friend of his and later added... "but it is mine!"

6 - He was also the Prop Master. 

He added, that he would "take the knife back so no actors would injure themselves." When asked about safety on set. He admitted to bringing and using a real knife on set. He also admitted to using a real operating drill for a scene, claiming that he did so to save money. No money savings can justify risking actors and crew.

5 - I was his personal assistant and had access to his phone and computer. And he has WITNESSES!

Really???? This is truly laughable. Why would I be the personal assistant??? I was the one with the money and the professional education and career. I did not have any access to those items. Alfieri guards his phone like the most valuable treasure. I would also LOVE to meet the witnesses.  Alfieri's great imagination is limitless.  

4 - He sued me because he is not a thief.

During his deposition he stated that he filed the lawsuit against me because I told his mother I was going to call the FBI and put him in jail forever.. and that he was not a thief. He then used the money he had taken from me - the money that was "in dispute" for which I had called him a thief. He used it to hire Roger Muse to sue me. If that is not stealing... well...  at least, it is an innovative way of investing someone else's money.

3 - He had a Facebook Hacker.

He gave a beautiful explanation on how "hackers" operate. According to Alfieri a hacker is an IMPERSONATOR.  I must have chatted and flirted with the hacker. I could have sworn he sounded just like Victor and looked exactly like him on skype. 

2 - He did not send personal emails to me. I must have "texted" myself.

Because he did not want to be held accountable for any emails or text messages that contained personal information confirming our intimate relationship, he claimed that I had access to his phone and that I could have easily texted myself.  Brilliant imagination!!!

And the most creative and memorable claim made by Alfieri:

1 - There were 8 people out there impersonating Victor Alfieri.

No words can describe how much joy and laughter this simple quote has brought into my life. I am grateful to Victor for coming up with such imaginative tales.

Found in Penal Code 118 PC, California law defines:

 "Perjury" - deliberately giving false information while under oath.

Prosecution

You are subject to prosecution for perjury if you willfully give false information in any of the following circumstances:

• when testifying in court,
• when being deposed,
• in a signed affidavit,
• in a signed declaration,
• in a DL 44 drivers license application at the DMV, or in a signed certificate.

Penalty for Committing Perjury

Perjury is a felony in California law. If convicted, the person could be sentenced to up to 4 years in the California State Prison.

Under Oath

Victor Alfieri was put under oath on August 16, 2012 during his deposition in Hollywood, California.  There were multiple discrepancies with his original version of the facts as stated in his complaint as well as with emails and text messages sent by him and his testimony.

Conflict on Set

During his deposition in August, 2012, Victor assures that there was no conflict on set.  Go to "Paranoia and Delusion" for actual pictures of Victor's emails to me.

"These are people that have hurt me and took advantage started rumors and turned against each other..." 

"...as far as nicole and her mom have them help u or joel I don't care....it s ur deal...as far as u didn't know they hurt me...well again I was there alone and working..." 

"...wanna be friends with those people that had hurt me...fine but don't drag my family or me in it too..."

In his emails to me, he continuously complained of having been hurt by people involved in the production of "Looking for Clara." He also stated that people took advantage of him and stole from him. If this is not conflict, then I don't know what would be.

Actors

During his deposition, he assured that Joel Moody and him had a very good professional relationship since the beginning of this film project. He also stated that Joel and he became very good friends when the movie wrapped in late May 2011. The following emails from Victor do NOT reflect what anyone would say about a very good friend.

"Joel Moody started shit from day one with Nicole Sienna." 

"Do you think Joel Moody is helping you for you? Or because he just finished a script? He s the one who complaind all the time in Italy, he s the one who did not move a finger when I needed help, he s also the one who complained to his manager for his check been one day late..." 

"Also because I am your friend....joel moody is the one who started making problems during the audition process and he is the one who did not move a finger when I needed help on set and continued with rumors against nicole and clark the whole time...he is young and money hungry...this is why producers or eps or directors never get too close to people they work with... also don't forget he was the first one to complain about his check been late to his manager...keep your distance ..play it safe...then after the movie is sold and completed do whatever you want...for clark and nicole is the same...and u saw it...be careful." 

"...can only tell you that I heard from Christine that Joel is flying to SF to see your friend and fuck her to get money for his script, she heard that from Clark, also I heard from other people about your comments on Joel 's photos on FB, I really don t care about all this, but please keep me and my professional aspect out of this mess." 

"So for Joel now seeking money( and he will get you the script if he did not do it already) from her or you is very unprofessional and not cool, but under the California law, any business he does with my contacts I am entitled to a founder's fee and a co-producer credit( same for you if I do business with your friend or you if you do business with any of the contacts intruduced by me) Again, this is why investors are not allowed on sets."

The same applies to Clark Gable. During his deposition, Victor stated that Clark and he were very good friends as well.  Go to  "Safety Violations and Abuse On Set" 

Alleged Harassment

During his deposition, Victor stated that Nicole never complained that Victor was sexually harassing her. In an email to me, Victor wrote:

"Nicole sienna accusing me to come on to her, just because i was too strict with her."

I believe that coming on to somebody in the workplace would be considered sexual harassment. Victor was well aware of Nicole's allegations. The three of us had a conversation about this very issue.

Crew

During his deposition, Victor was asked if any crew member had stolen from him. He clearly said that it had not been Roberto or Max.  The following are excerpts of Victor's emails to me.

"Like Roberto Moscioni stole money from equipment and asked behind my back for more money for gasoline to you and me both." 

"Roberto moscioni .....never signed a contract, and because he stole money from me. NO half POINT." 

"Max Trevis and his brother....stealing money again and so on..." 

"I am shocked about the stuff I am finding out about Cristina......I am hurt and shocked. I will tell you later."

Why would Victor accuse the crew of stealing and then deny having said so? It would be understandable that he later found out that the crew members did NOT steal. But why deny ever accusing them?

I personally believe that Roberto and Max did NOT steal anything. They worked hard and did an excellent job!

Production Expenditures

I do not believe that Victor has provided me with the proper receipts to justify all production expenditures. However, I am not going to discuss this point as I have retracted my fraud allegations.

Property Ownership

When I met Victor in 2009, he told me that he owned three properties in Italy. He said that he had paid cash for them and had no mortgage. He owned two houses - his mom's and his, and a large piece of land. He also told me that he was having problems with his mortgage in the US.

Before I invested the last $90,000 in this film project, Victor had suggested that I buy his piece of land in Italy worth about 75,000 euros (at least). He showed me the property with google earth. I remember him saying, "it also has many olive trees."  Victor thought that if I did not buy the land it could at least serve as collateral so I would feel safer with my investment.

On August 16, 2012, during his deposition, he denied ever owning any property or land in Italy. I wonder, was he trying to sell me something that he did not own? Why would he tell me that he owned 100% of his house and his mother's when it was not true? He told me that he was allowing his mother to live in his second house, that his mother worried that it was in Victor's name and not hers. Under oath he stated that he did not have a house in his name in Italy.

Personal Relationship with Me

In his original complaint filed against me, he stated that I was a fan who became obsessed with him. He also alleged that I was harassing him and trying to sleep with him. When I realized that he would never sleep with me, I became hostile, accused him of stealing, slandered him by saying he slept with me and stole the footage of the film. In this complaint he also stated that I was his "personal assistant" and that he gave me access to his email account, computer and telephone.

During his deposition, he did not mention that I was a "fan." What he said is that I was a very close friend, the type of friend "who is always there for you." So which one is the truth? Obsessed fan or close friend?

He, of course, denied our intimate relationship and lied about major facts. All this information will be disclosed in future posts. I will provide, text messages, voice mail messages and footage from the deposition.

I believe that the biggest lie he told is the story he gave about our relationship. There is no confusion or memory issue explaining our relationship - we either had an intimate/sexual relationship, or we did not.

Update - As of September 20, 2013, a year after our depositions, it has become more evident that Victor Alfieri and Joel Moody are very close friends. Victor might have not lied about their friendship. Those two have probably been in communication the whole time - from the time Victor and I broke up until Joel and I stopped talking to each other.

I remember two years ago confiding in Joel and telling him how hurt and shocked I was by what Victor had done to me. "How can anyone do this to the person who has helped them, believed in them and given everything to them???" I remember telling him. Joel interrupted and said, "Well, Victor is a very good-looking man." To what I replied, "What??? What does that have to do with this???" Just as if looks would justify this type of behavior. 

One day when Joel was visiting me, I was busy sending some last minute emails. He was standing behind me waiting for me to finish. He then loudly said, "oh my God!" And I said, "what's wrong, Joel?" He was looking at himself in the mirror next to my desk. He added: "Look at me! I look exactly like Victor. I get it.... He cast himself in his movie. He cast me because I look just like him... Wow I finally get it." This was bizarre to me. Why would anyone make that type of comments? 

Look at the picture above. This picture was taken a few months ago during the screening of Alfieri's new short film. Isn't it interesting that the two of them are wearing the exact same outfit?  And now I wonder... Are they so close that they talked on the phone and coordinated their wardrobe... or is Joel morphing into a copy of Alfieri?

Telling the Truth

The Truth Will Set Me Free

In early August of 2012 we had our depositions taken. I was to be deposed for two days. Victor was not required to attend my deposition. He was only required to attend his own. I was shocked when I saw Victor show up to my deposition. I believed that he would not dare see my face again after all the lies he had said about me.

He and his attorney mocked me. Victor would laugh at my answers while I was being deposed. Below there are a few lines from the transcription of my deposition.  Mr. Hakimfar is my wonderful attorney. I am the witness. Mr. Muse is Victor's attorney.

MR. HAKIMFAR: Excuse me, Counsel. Can you ask your client to keep his amusement to himself? It's incredibly disturbing, not only to myself, but to my client.

MR. ALFIERI: I have a cold. 

THE WITNESS: Oh, yeah, he has a cold. 

MR. ALFIERI: I'm sorry, I do have a cold [sarcastically laughing]

MR. HAKIMFAR: But we're in a room with six other people here -- 

MR. MUSE: It's agreed on. 

MR. ALFIERI: I said I'm sorry [sarcastically]

MR. HAKIMFAR: That's fine.

I was asked if I believed Victor had lied when he stated to others that he had never been romantically or sexually involved with me.

Of course he was lying, because we were involved. And that's why I invested the money. He used me. He had sex with me to get the money and then he said that I harassed him, which is horrendous. Only a monster would do that.

As I was saying the last words... "only a monster would do that," I turned and looked at Victor. He looked at me and winked. Unbelievable..... Then he distorted his face to appear like a monster.  

In July 2012, I filed a proposed cross-complaint with detailed allegations and additional causes of action. When asked why I amended my cross-complaint, this is what I answered:

Q. At the time you filed your first cross-complaint did you feel you should not mention these facts?

A. I wanted to protect everyone's name. 

MR. MUSE: I'm going to strike that as not responsive.

Q.  Do you want the question to be read again?

A.  Yes. 

MR. MUSE: Please read the question. (Question read.) 

THE WITNESS: I thought -- I felt that I should not mention the facts. No, that's not correct.

BY MR. MUSE:

Q. What is correct, then? Explain it.

A. I could have mentioned facts, but I wanted to protect some of the people involved and I did not want to mention any names.

Q. I'm not sure I understand. Certain facts that you knew of at the time you filed your cross-complaint are not included in your cross-complaint. Correct?

A. Correct.

Q. They're included in your proposed cross-complaint?

A. Correct.

Q. Okay. As to those facts, why didn't you include them in your first cross-complaint?

MR. HAKIMFAR: Objection; asked and answered.

THE WITNESS: I did not include them because it mentions people specifically and what happened to them specifically, and I was protecting them. 

BY MR. MUSE:

Q. So you refrained from adding these facts to protect the people that they refer to?

A. Correct.

Q. What made you change your mind as to protecting these people?

A. That I should tell the truth.

Q. So at some point you ceased to want to protect them?

MR. HAKIMFAR: Objection; misstates the testimony.

THE WITNESS: I wanted to tell the truth.

MR. MUSE: I'm going to strike that as non responsive.

Telling the truth is not a good reason???? Mr. Muse took my answer as non responsive.

Q. Did you understand the question?

A. Can you repeat it?

MR. MUSE: Go ahead and repeat it. (Question read.)

THE WITNESS: Well, yes.

BY MR. MUSE:

Q. Why did you change your mind about protecting these people?

A. There was nothing to protect from the truth.

Q. Again I'm going to ask the question again. Why did you change your mind as to your desire to protect these people?

A. That's my answer: because when you tell the truth there's nothing to protect. That is my answer.

When you tell the truth... there is nothing to protect.  And that is WHY I am sharing my truth! It is too bad that Mr. Muse does not agree that telling the truth is a good enough reason to do anything. 

MR. MUSE: Strike that as nonresponsive.

Q. Is there something you don't understand about the question?

A. I understand your question and that is my reason. If you don't like my reason then it's not my problem.

Q. I can compel you to give me a correct answer if the answer is not responsive. 

Do you understand that?

A. You're asking for a reason?

Q.   Correct.

A. That's my reason.
