Independent Filmmaking

I still remember the day I read the financing agreement. The contract was clearly one sided and favored Victor in every single way. He would get my money to pay for the production of the movie. He would also be paid about 25% of the total budget for his "services." I would be risking my life savings and would not get anything in return if the film failed or did not reach completion. I am not stupid and knew that the contract was not fair at all. Why wouldn't I take over the rights to the film if Victor breached the contract? I am the one financing it, right?  I remember jokingly telling him. "Wow, this is such a one-sided contract. You are not going to stab me in the back, are you?"  He quickly responded without looking at me, "of course not. I would never do that to you. I love you, baby."

After he responded to me, something felt really wrong. I felt a sharp pain in my stomach. I ignored it while I talked myself into this "generous act" I was doing for the man I loved....  and failed to hear my own inner truth.

Alfieri took advantage of my lack of experience in filmmaking. He led me to believe that I would virtually have no rights even though I was the sole financier of the film. The person with the money should have control and ownership, right? But that is not what Alfieri believes. He claimed to be entitled to my money, to all production decisions and to the rights over the film.

Almost three years after I signed that financing agreement with Alfieri and Bondolini Productions, I have acquired much more experience in independent filmmaking. I have learned that the toughest obstacle to overcome is the financing of the film. I have worked with production teams in raising funds and attracting investors.

These great teams with which I have worked, have been really appreciative and grateful for my contribution to the film. These films have great scripts and wonderful actors already attached to the projects. But why aren't some of these films in production already? Because the complete budget has not been raised.

This was not the case for Victor Alfieri. I gave him the greatest gift any independent filmmaker could ever wish for - I financed his dream!

How Did Alfieri Pay Me Back?

He took my money and did not thank me once. In fact, he acted as if he were doing me a favor by "allowing" me to invest in his great masterpiece. He eventually took what was left of my money and used it to hire and attorney to sue me.

The "traumatic" experience financing and producing "Looking for Clarissa" (formerly "Looking for Clara") turned my whole existence upside down. There were so many false statements about me made by Alfieri all over the internet. The assumptions people were making about me were harming my personal and professional life while tarnishing my reputation. I felt I had no other choice but to give my side of the story.  I became brave to speak my truth.

Just right before the Trevino-Alfieri story started, I used to be so afraid to speak up if it involved "telling on" somebody or  simply disagreeing with someone else's opinion. I wanted to be liked and accepted by everyone.

I have finally learned that my former people-pleasing attitude does not serve me any longer. It does not serve me, or anybody else, for that matter.  Who wants to hear lies or "sugar coated" truths? Some might say that they prefer to hear "white" lies instead of something hurtful. Is this actually true? If we search deep inside of us, we will find the answer... We are always looking for the truth. Being ready and able to face other people's and our own truth... That is a different story.

So do we bluntly state our likes and dislikes? There are always multiple ways to say the same thing without lying. There is nothing wrong with being polite and considerate towards others when communicating. In fact, that is the way I choose to live my life. But, there is a line that, when crossed, blurs our sense of self-respect and integrity.

How do we know we are crossing that line?  We ALWAYS know. It is that feeling in your gut - a sudden blow to the stomach, alerting you that you are stepping into a situation that goes against yourself, a situation that will throw you off balance. This experience certainly knocked me to the ground. Two years have passed... I have gotten up. I am standing strong in my truth, facing the present with honesty and looking forward to the future.

Last Thursday I went to the Los Angeles Superior Court to refile my lawsuit against Victor Alfieri and Bondolini Productions. I went to the window and asked the lady, "what forms do I need to fill out to refile a lawsuit I had dismissed without prejudice last year?" She told me that she did not know and gave me a three-ring binder with a long list of forms used in court.  I asked two more clerks. Nobody seemed to have an answer - not even a "general" answer. The last person I asked, suggested I talked to an attorney. "Good idea," I thought, "I will contact one of the attorneys who represented me in this case."

I contacted one of my attorneys and left him a voice message explaining that I would be refiling the lawsuit and would proceed "pro se."I simply asked him to guide me a little by telling me which forms I needed to refile this case. He sent me a text message - "there are multiple forms." "OK," I thought, "I know that... but which are those multiple forms?"

I went home and did some research on line. I found "justanswer.com" a website with attorneys who answer questions for a nominal fee. I asked this question (about the forms) and was told that $18 would be the smallest fee I would pay, considering that it was not complicated and I was not in a rush. Thirty minutes passed and I had gotten no answer from this site. An hour later, I received an email from this site requesting more money, claiming that the answer was complicated.

I continued searching on line and found Avvo - a great free service. They gave me concrete answers and good advice. This is one answer I received.

Assuming the claim isn't barred by the statute of limitations, you need a complaint, summons, civil case cover sheet, civil case addendum, and have to pay the filing fee, unless you have a fee waiver.

This service was completely free. I can't believe justanswer.com wanted $40 dlls to give me this information.  I went to the Los Angeles Superior Court website and actually found the same answer. Refiling a complaint that has been dismissed without prejudice is just like filing a new lawsuit and needs the same forms.

What has happened to the legal profession, specifically attorneys in civil cases? It seems that it is always about money. They bill for EVERYTHING!!! If they cannot get compensated monetarily for every single word they utter or type, they are not interested in helping you. Is that what they learn in law school? Are they taught to care about justice and fair respectful treatment of non-lawyers? Or is it all about making money? Don't they get paid enough already????

Fighting for Justice

Can a person fight for justice in the court system without legal counsel? Not really. I believe that the court system is designed in a way to make sure people are represented by an attorney. A simple request  for a "continuance" of a court hearing has to be done in such a way that only attorneys know. Judges get really irritated when a person opts to go to trial "pro se." But don't we have the right to do so if we cannot afford an attorney in a civil case? In theory we have the right. In reality, we don't stand a chance to "fight for justice" in the judicial system if we are not represented by an attorney.

Victor Alfieri got intimately involved with me and convinced me to trust him and to invest in his independent film. He then hid our relationship and started slandering me claiming I was obsessed with him and was sexually harassing him. When I disclosed our intimate relationship to his manager and the production attorney, Alfieri took the rest of my money, disconnected his phone and disappeared (went into hiding). Alfieri then sued me because, as he stated during his deposition, I called him a thief, I accused him of "stealing money that he never stole." Then he used that same money to hire attorney Roger Muse to sue me and slander me in the process.

Now Alfieri is doing whatever he wants with the movie. He is not respecting the agreement and does not care to listen to my feedback on the "amateur" film he made with MY money.  Is this fair???? Is it fair to just "move on" and do nothing about it???? I have moved on as to my personal relationship with him - that relationship died while filming in Italy. But what is wrong with wanting to recover what he took from me?

I did not refile the lawsuit against him. I will be consulting with an attorney in a couple of weeks. I know the statute of limitations will bar some of the causes of action. So that is why I need to act in a timely manner. I might file a brand new lawsuit that will include many of the other parties involved... or, I might just forget about the false sense of "fighting for justice" in the judicial system and let God take care of it.  Please read Above the Law for updated information.

It is certain that "what goes around, comes around."  I know that "justice will prevail" - not necessarily through the judicial system... but through the events that keep unfolding. There is always a BALANCE. It is up to us to find our own inner balance and peace... I continue working on maintaining that equilibrium.

Sunset Boulevard

This morning I was walking by the Coffee Bean on Sunset Blvd., I thought of Victor Alfieri and how funny it would be to run into him there. I even imagined cheerfully shouting out "Alfieri" with a big smile on my face.... when a man twirling his hair got my attention...

This man was compulsively twirling the hair that was sticking out of the bandana he was wearing over his head. This is something Victor would do all the time. I remember I would slap his hand when he did  that and would say, "stop doing that!" because it truly got on my nerves.

When I got closer to him, I observed, his face, his profile, his clothes.... It was Victor Alfieri!!! I think he also saw me but pretended he did not know who I was. He immediately put his headpiece (connected to his cell phone) in his ear and started walking the opposite direction.

Larrabee Street

Last year, I was living in an apartment on Larrabee and Santa Monica Blvd. He knew I lived on Larrabee because I had told him I moved there.  This is before we broke up and, of course, before the scandal erupted. However, he did not know the exact address. Please see map on left. "A" is where I used to live.

After publicly accusing me of being obsessed with him and of "stalking" him, I found him following me and driving by my apartment building several times.  Anyone from West Hollywood knows that Larrabee is only 3 blocks long. There is really NO reason to drive on Larrabee if you don't live there or if you are not visiting someone who lives there. San Vicente Blvd, a major street, is just a block away from Larrabee Street and can connect you to Santa Monica Blvd or Sunset Blvd.

It was clear that he wanted to know where my apartment was and spent numerous hours driving down the short 3 block street trying to figure out where EXACTLY I lived. I remember one day as I was exiting my garage, I cut off a car that I was approaching. I waved at the car with an apologetic gesture. I realized it was Victor's Porsche... with Victor inside. Because he was right behind my car, I could see him in my rear view mirror. We were both heading toward Santa Monica Blvd. We were going to have to make a right turn. But, through the rear view mirror, I saw how Victor freaked out and made an immediate left into an alley. At that point, he had succeeded in finding out where I lived.

Just a couple of weeks after this incident, a mutual friend who was visiting me saw him on the corner of Cynthia and Larrabee. I actually met this mutual friend through Victor, himself. He also had problems with her and they were not talking anymore. He was again in his Porsche signaling that he was going to turn right onto Larrabee Street, my block - and as I said before - really no reason to go that way. He saw my friend and "freaked"... What did he do this time?  He continued going straight on Cynthia with his right blinker still on!

Why would he drive by my place???? What was he expecting to get out of it??? Was he spying on me?  So who was stalking whom?

When he and I started talking again after I dropped my lawsuit against him, he was very persistent in getting my new address. He claimed he would send a copy of the first cut of the film by regular mail. I refused to give my home address to him although by now, he probably knows it. He proved to be a good investigator.

It is really ironic how close the two of us are geographically. Next time we run into each other, I hope to be able to say hello and communicate like two adults. He is the one who started all the conflict. He is the one who created a slanderous lie about me that grew too big to be manageable. If he offered his sincere apologies and told the truth about what really happened between us.... Well.... I could only dream!!!!

Sexual Addiction?

Defamation

Victor defamed my reputation when he made false allegations about me in his lawsuit. The following paragraph caught the attention of sensationalist reporters at TMZ.

"At his manager's urging, ALFIERI did, however, agree to meet TREVINO for lunch on her birthday on July 21,2011. After they had finished their lunch and were standing in the restaurant, parking lot, TREVINO grabbed hold of ALFIERI and tried to kiss him. Without letting him go, she asked him to have sex with her, stating that they both needed to 'release some stress.' When he refused, she asked that he at least email her a picture of his 'c--k' which she could masturbate to. ALFIERI was embarrassed by the scene they were making in public, and so to put an end to it, agreed to send her a picture. Later that evening TREVINO texted him demanding the photograph. In response ALFIERI emailed her a link to a photograph of a dildo for sale on Hustler's website. TREVINO's email response was that she would rather have ALFIERI's 'live' organ."

And we know what happened when TMZ published the following article. It went viral. It was translated in many different languages.

This article was so popular with TMZ, that it remained as one of the top ones for over a week - which is a lot for Hollywood and its superficial gossip.

TMZ reporters called me constantly and wanted to continue writing about it. I remember a conversation I had with one of them. She said to me, "this is what we need from you, text messages, pictures of the two of you together and.... the picture of the dildo that he emailed you."  I replied, "the picture of the dildo? Why?" She assured me that by doing so it would help me. I did not see how it could benefit me or anyone even if I wanted to tell my side of the story. 

I did not give them any more information. They asked me to contact them when I filed my cross-complaint, as they wanted to publish it and help me out.

I received emails and requests from magazines to give interviews. I refused to do so because of the pending lawsuit. I did not want to make things any worse.

When I filed my original cross-complaint in November 2011, TMZ was no longer interested in publishing my story. Why??? It was not scandalous enough!!!  It is sad how the media is more interested in giving the UGLY side of a story. To them, it does not really matter what they publish, as long as it sells... "If it bleeds it leads."

My Version

Victor invited me to lunch on my birthday. We met at TENMASA on Sunset Blvd. That was our restaurant. We would go there at least twice a month. It was so heartwarming to see how nice and sweet he was  to me - just as he was before going to Italy. In fact, he was even nicer. After all the arguments and conflict we had, this birthday lunch was like turning back time.... to the good times we shared. He came with a bouquet of flowers and a birthday card. We laughed during lunch and had a very good time. For a moment I felt as we had gotten back together.

"On July 20, 2011, Alfieri invited Trevino to lunch to celebrate her birthday.   Trevino believes it was because she was demanding monies returned from his ludicrous salacious endeavors back to the production financials.  Alfieri arrived with a smile, flowers and a birthday card to buy time. After lunch, Alfieri held Trevino in his arms, kissed her and said: 'I know you miss me. I know you miss my ‘pito’ [in Spanish, a whistle, or a child’s word for penis] … Baby, I cannot give it to you today but I will send you a picture.'  The following day, Alfieri emailed Trevino a picture of one of his black dildos from his collection."

How this scandal affected my professional and personal life

Since this big media scandal, I have lost about 40% of my business. I was nearly banned from Televisa in June 2012 when I was there working on a tv show. I got messages on facebook and even LinkedIn with inappropriate requests. All this because of this scandal and people's perception of me - a woman of questionable reputation who likes pictures of xxx.

During the summer of 2012, I had a meeting with a Head Executive of an organization with which I have been working part-time for the last couple of years. And this is the conversation we had.

Executive - "I have a problem with you... I will be blunt and tell you." 

Me - "Yes?  What is it?" 

Executive - "Adriana, you're a sex addict and you need treatment."

I actually started laughing. How ridiculous!  Sex addict? I hardly have any sex. And I for sure do not exhibit the symptoms or behaviors in the above definition.

Me - "And why would you say that?" 

Executive - "Because of that lawsuit... because of what that actor says."

Me - "His allegations are all false. I already told you so." 

He continued justifying his position, stating that he had observed me and he knew I had a problem. He gave me different examples of people with addictions. Our conversation ended like this.

Executive - "You either get treatment or you are out of our organization."

This is just one example of what I have gone through the past year and a half. This perception people have created of me is significantly affecting my professional and personal life... another reason to speak up and tell the truth.

Even my sweet mother had the wrong idea about me. And she has known me my whole life. One day when we were talking about the lawsuit and all the challenges I was experiencing, she asked me: 

"What type of movie did you make with Victor???? Porn?"

Was I Set Up?

UPDATE-- OCTOBER 9, 2015  -- I filed a new lawsuit against Victor Alfieri with claims of Fraud as to my investment in this film.

Disclaimer: I am not making allegations of fraud as to the production of the movie at this time. I am only addressing the Alfieri's set-up to prove I had committed libel/slander.

I suspect that Victor Alferi was plotting to get my money for the movie and then get rid of me by claiming that I harassed him. I don't believe that it was a plan that he knew for sure he would implement. I think it was one of his alternative plans. I personally believe that he "plots" as he goes...

In fact, just because we are now "working together to get the movie distributed", that does not mean he has the intention to honor our original investment agreement. Why would he? He has breached the agreement numerous times.

It is interesting how trust is a "reflective" verb. If you are not to be trusted you tend to be distrustful. Victor is a person who distrusts everyone. He also "plays" everyone against one another. He told me that he wanted to get rid of Christine, Rachel Kennedy (previous investor), Sergio D'Amato (previous investor), Marco Cuadros (his manager), Joshua Fine (production attorney), Max Trevis (DP), Lorenzo diNola (data manager) and some of the actors as well. And of course, he told some or all these people that he wanted to get rid of me.

I will not get into what he said about each of these people since that is not the purpose of this blog. What I will mention is the blatant set-up to accuse me of slander/libel.

He started telling people in the production that I was obsessed and wanted to sleep with him, that he wanted to get away from me,  - basically that I was sexually harassing him.  Then when I disclosed the truth about our relationship to Marco Cuadros and Joshua Fine, he took what was left of MY money, disconnected his phone and disappeared.  When I asked for the money back, he sued me.

He did not have a true reason to sue me. He knows that. So he had to come up with something. As I said before "plotting-on-the-go"... He had already been saying that I was sexually harassing him. I had already disclosed the truth about our relationship. He had taken and concealed MY money without authorization... So why not sue for slander/libel???? That way he would maintain his position that he was never "involved" with me and that I intentionally and maliciously lied to hurt his reputation.

Slander or libel do not mean much unless they result in financial loss. He needed to have some proof of this. So what did he do????? He recruited former actress Apollonia Kotero to help him with this scam. The reason I am mentioning her is because I am certain that she deliberately lied for Victor. I also suspect that there are other people involved in some not so legal/ethical practices with Victor.  Because I have no real proof of any wrongdoing, I will not mention any other names.

Victor asked Apollonia Kotero (Prince's Purple Rain) to contact me to see what I said about him and if I would "slander" him. She contacted me on August 5th, 2011, just two days after Victor took and concealed my money. I said nothing about Victor or the money.

Hola Adriana, Thank you for staying in touch with me. Gate events are always appreciated . How are you lady? What is new with Gate...been quiet. Several months ago I asked Gate if they had scripts that needed funding. I also asked your friend that intro'd us , Victor Alfieri if he had scripts. I sent emails to several writers asking for scripts to be budgeted films$ 5-8Million . I have funding to develope properties.   So Victor Alfieri sent us a script that we like very much "Colombo.   Trying to reach him but he is m.i.a.....??   I have called his number attached to script & it's disconnected. My emails are "truncated". So was wondering how you & Victor's  movie is coming...?  You both are making a movie? Am I correct? Bit confused as to the lack of follow up. Thank you kindly for your help Adriana. Hope you are well & happy!  Disfrutando la vida!!!

As to Victor, I am aware of your close friendship with him.  I know you two keep in touch. I don't understand why he has not contacted you lately.., And to be honest Apollonia, he could have asked you to contact me to see if I say anything about him.  We are in the middle of a legal battle and I don't want you to be caught in the middle.

Which I found odd. I mentioned budget ect. to John via email.   So.....in the course we have been reading many scripts anyhow. I did subscribe to Gate early this year thanks to you Adriana. I will recheck as I have not received info...maybe I did not do correctly. Will have my assistant check. Again, thank you so much for this info. I am sorry this has happened. Can't imagine...he seems like a decent guy. The script we have here is well written & could be shot in Spain. We have access to this. Shame! What is going on with people nowadays! Thank you again for your letter Adriana. Perhaps it is best for me not to land in the middle of this . I have spoken to my lawyer Lavely & Singer... who has advised me to speak with Victor directly regards the script and hear his side of this . As I have also heard your point of view in all fairness.  This situation is quite discerning and  I am sorry for all involved in this . My efforts were to search for scripts to be developed in Spain such as the  "The Dreamer" with my producing team. I truly wish you all the best outcome. When I received discovery from Victor's attorney in the spring of 2012, I realized that Apollonia had forwarded Victor my email messages immediately after she received them. It is evident that she plotted this with him. Why would she assure me she had not heard from him and that he was "missing in action" when the two were communicating????  To set me up.

I still had Apollonia Kotero as a friend on facebook... until I learned that she was closer to Victor than she would care to admit.

After this communication on facebook, I deleted her and blocked her. That is why her picture does not appear in the chat printout.

I really do not know why Apollonia Kotero would become part of a scam such as this. Maybe she is "intimately" involved with Victor??? She herself told me that she had never been in a scandal... but she certainly got herself into this "mess" as she calls it. She was listed as a witness against me in this lawsuit.

I believe that her emails and facebook messages tell the real story.

I knew that Victor had sued me the day before, on the 20th, when my attorney friend, the one who wrote the letter to Victor, called me and emailed me the complaint. When I saw it, I though it was completely ridiculous. In fact, I did not read it carefully, as it contained lie after lie and made no sense to me. I had not been personally served with papers, so I opted not to worry too much about it.

What I never expected is what happened on the 21st of September. I received an email from my good friend Jonathan.

I immediately clicked on the link. My jaw dropped as I read it. I started to wonder how Jonathan saw this link. Was he searching for me or Victor specifically? Why would he read this specific article? How much was on the web?

By Sunday, September 25, 2011, TMZ wrote an article that eventually traveled the world translated in several languages. I was shocked when one of my clients in law enforcement sent me a text message with the tmz link inquiring "do you know this guy?"

I read it, immediately talked to my attorney friend. She told me to respond and tell the truth. So that is what I did.

A super good looking soap opera stud claims he's being victimized by an obsessed female movie producer -- who allegedly has it out for him because he refused to email her a pic of his "live organ."

Victor Alfieri -- who starred on "The Bold and the Beautiful" and appeared in the movie "Angels and Demons" -- is also an aspiring filmmaker ... and claims a female fan decided to invest in one of his projects last year.

Alfieri claims the woman, Adriana Trevino, dumped more than $150k into his movie -- but it soon became clear that she wanted a sexual relationship with Alfieri as part of the package deal.

In his lawsuit, filed in L.A. County Superior Court, Alfieri claims Adriana would often try to get frisky with him -- one time suggesting they have sex to "release some stress."

Alfieri claims he turned her down ... so "she asked that he at least email her a picture of his 'c**k' which she could masturbate to."

Alfieri claims he again refused ... and instead emailed her a link to a photo of a dildo -- but Adriana replied that she would rather "have Alfieri's 'live' organ."

According to the suit, Adriana finally got the message ... but instead of quietly moving on, she allegedly stole the footage from Victor's movie ... and refuses to give it back.

AND THERE'S MORE ...

Victor claims Adriana contacted his mother who lives in Italy -- and told her that they were humping ... which in turn caused Victor's mom to FREAK OUT so bad, she needed to be hospitalized.

Victor is begging a judge to force Adriana to return his footage -- plus he wants unspecified monetary damages.

The producer who is being sued by soap star Victor Alfieri claims she was just joking when she asked him to send her a pic of his privates -- and says the two were in an "intimate relationship" until Alfieri broke it off and ran off with her money.

Adriana Trevino claims she began working with Alfieri on a movie in June 2010 and their relationship began around the same time. Trevino says Alfieri wanted to keep their relationship secret, which she did, until she heard that Alfieri was telling the crew of their movie that she was obsessed with him.

Trevino says she came clean about the relationship and as soon as she did ... she says Alfieri withdrew the rest of her investment in the movie from the bank. She says he disconnected his phone and disappeared.

As for his claims Trevino was somehow involved in landing his mom in the hospital, she says the mother and her were quite close. Trevino says she went to the mother when Alfieri disappeared, and when the mother tried and failed to get a hold of her son ... she had to be rushed to the hospital.

She explains the penis pic request ... saying Alfieri mentioned sending her a pic and she was merely asking for what she was offered.

Trevino says she's planning to sue for slander. 

By September 27, there were over one million links covering this scandal. I received emails and calls from magazines and reporters who wanted to get an interview with me and my side of the story. TMZ called me constantly to get more details so they could continue covering this "juicy" scandal. I refused to give any more information per my new attorney's advice.

Never in my life did I expect to be involved in a Hollywood scandal such as this. Now I wonder what would have happened if I had told the truth, the whole truth... everything... from the beginning. The scandal would have died right then...

And what if I had told the truth to the production cast and crew about my intimate relationship with Victor?... then all of this could have been avoided.
