Turning a Loss into a Win

About three weeks ago, I had a Case Management Conference hearing. During that hearing we were to deal with the Demurrer filed by Victor's attorney, and Motion to Strike portions of my Complaint. Jason Fisher, Alfieri's attorney, had changed the date from January 29th to January 22nd, a week earlier, giving me very little time to file my opposition to his two motions filed on December 12, 2014.  I had  until January 8th - only 26 days to respond. And these 26 days included 14 days I spent in Mexico during the holidays. So basically, I had a little over one week to prepare my opposition and what I was to present and say in court.

It is true that I am representing myself in this case. Hiring an attorney would cost me a fortune. I have  fortunately managed to pay some money to an attorney to prepare and go over the complaint and the opposition to the demurrer. I also asked a friend of mine who is also an attorney and a former judge to give me advise on how to address the court. He told me that he presided hundreds of hearings. He added that, because I was representing myself, it was important to show myself as a "human being."   He helped me prepare the following "speech."

Your Honor,
I am aware this court handles many cases of greater importance and significance than mine. I feel fortunate to be here in front of you at this time to address the motion filed which is to challenge any defects of my complaint and the issue of subject matter jurisdiction. 
Your Honor, my amended complaint sets out facts that are consistent with the causes of action and furthermore are alleged in accordance with the California Civil Procedure Code. I've listed the elements of each cause of action and drafted the complaint in accordance, eliminating any uncertainty or ambiguity.  There is particularity and specificity with respect to all claims, and all provide sufficient information as to clearly state a cause of action. 
Victor Alfieri and Bondolini Productions filed a lawsuit against me based on the production financing agreement and I ask the court to find that defendants have waived their right to arbitration. 
Your Honor, I am here today without counsel because Victor Alfieri has taken my life's savings of  $150,000. That was all the money I had in the world. He took the last $17,500 of my money to hire counsel to sue me. 
Your Honor, I know of nowhere to turn except to this court -- so I might, during discovery, bring all the proof needed to demonstrate fraud beyond clear and convincing evidence and that the money taken from me was for defendant’s personal use. 
As the pleadings allege, Victor Alfieri started a romantic relationship with me for no other reason than to secure my life's savings. He claimed to love me and further claimed that starting a production company as partners, would be a way that would allow the two of us to grow in our relationship and assure financial stability for the rest of our lives. 
Defendant never had any ambition of owning a production company or producing a movie. Most all of my money was used for Victor’s personal benefit. 
After giving Victor my life's savings, which he assured was all that he needed -- as it is also reflected in the contract -- he later writes and tells me he needs another $131,000 stating, "no money, no movie.” 
Your Honor, if the court requires I amend the pleadings, I will comply. However, your Honor, I ask that you allow me the opportunity to go forward with this case so that I can collect the necessary evidence and prevail.  He took every dime I had, your honor, and Victor has a pattern of this sort of behavior. 


So the day arrives. I ask my friend Christine to go to court with me. We arrive very early and check in.  I am nervous. I have been to court hundreds of times -- literally HUNDREDS of times --  but as a certified court interpreter, not a plaintiff in PRO PER.

Christine's presence calms me down. She tells me that everything will be okay. I then close my eyes and think of what Marianne Williamson always tells us to do in stressful and challenging situations such as this -- "Before you enter, blast everyone in the room with love."

We sit in the courtroom while all the other cases are called. I get to see how pleasant and fair the judge is to the other parties when handling their cases.  I am feeling much better. My case finally gets called. I approach and sit at a table facing the judge. Attorney Jason Fisher, is to my right. He does not even dare to look at me directly.

I have met and worked with over one thousand attorneys. This is not an exaggeration - over one thousand. And I can assert that Jason L. Fisher is the rudest lawyer I have ever met in my entire life. He refused to shake my hand when I extended it to him the first time we met in person. He does not respond to my emails or phone calls. So I am not surprised with how things unfolded during this hearing.

The judge states that her tentative ruling is to sustain the demurrer and send the case to arbitration. She then starts reading each cause of action, giving a reason why the demurrer is sustained. "As to Cause of Action 1, Fraud in the Inducement... it lacks... does not state specific... demurrer is sustained. As to Cause of Action 2... Cause of Action 3... 4... 5... 6... 7... demurrer is sustained."


I cannot believe that none of the causes survived the "demurrer" since the complaint and opposition to the demurrer were drafted and reviewed by several attorneys. None of the causes of action is properly pled???!!!  But what is more surprising to me is how calm I am. I feel this inner peace and stillness that is hard to explain.

The judge looks at us and asks if there is something we would like to say. Jason Fisher is quiet and looking down avoiding the judge's eyes. I say, "I don't know if he wants to say something first," referring to opposing counsel. The judge quickly answers, "he does not have to say anything. He won. You lost... So anything you want to say?"

At this point I am just looking at the piece of paper with my prepared speech. I cannot really read that now. I just lost, as the judge clearly stated. I do address the court and state that the first cause of action, Fraud in the Inducement goes beyond the contract containing the arbitration clause. I say something like this , "there was an agreement and promise made by Alfieri to start a production company together in July 2010. We were planning on making several movies. The first movie was 'Arturo Bond,' whose main character is Arturo Bondolini - that's why the name, Bondolini Productions. I invested money in that movie project first. By September 2010, I had already invested $60,000 into that specific movie - seven months before the production financing agreement with the arbitration clause was signed.  We did not produce "Arturo Bond," but decided to make a different film, 'Phoenix.' This film was not produced either. We then decided to make 'Looking for Clarissa.'  The false promise I am talking about is the production company. I was induced to invest in this last movie based on the false promise of a production company."

The judge looks interested in what I am saying. She says, "where is that stated in your complaint?" I read a couple of paragraphs from my amended complaint that do not cover what I am trying to convey. Because I was told by several attorneys to shorten my original 42 page complaint, my amended complaint does not have that specific information and dates that now I desperately need.

The judge then asks, "what is the reason why you don't want to go to arbitration?" I politely answer, "because it is my understanding that fraud allegations cannot be handled in arbitration." To what she responds, "that is not true. Fraud is handled in arbitration" just as it is handled in court. My eyes light up, "really?" I say with an evident tone of surprise in my voice. "She then goes to explain how arbitration works, that some arbitrators are former judges, that we get to choose our arbitrator.

Mr. Fisher says that he told me about arbitration over the phone, making it sound that he had been polite and tried to settle this before filing all those motions - which is a complete lie. In fact, that initial phone call was the ONLY conversation we had and it sounded to me more like "this is war" than anything else.

Attorney Jason Fisher starts going on and on about my refusal to go to arbitration, about the -- as he puts it -- "exorbitant" number of hours he put into writing those motions. Again, trying to make me look like an unreasonable person who filed this complaint with malice and in bad faith.

The judge points out that it is understandable I would not believe what he was telling me as he is the opposing attorney. Why would I trust him? Why would I follow any legal advise he could offer? Then she looks at me with so much compassion in her eyes and asks me, "why are you so scared to go to arbitration?" I say, "because for the first cause of action, Fraud in the Inducement, I could be awarded punitive damages - something that cannot be considered in arbitration."

The judge is now looking at me directly, being as impartial as required by her position but unable to hide her kindness and concern. "Don't be scared. All those things will be dealt with in arbitration." She adds that arbitration is pretty much like trials in court, but much more informal.

The judge looks satisfied that the case will be taken to arbitration. She then says that the case will be stayed, both parties will stipulate to arbitration, and that the case will be dismissed after arbitration is completed. Attorney Jason Fisher states that they will not agree to that stipulation, "Isn't arbitration what you wanted, counsel?" the judge asks puzzled. Mr. Fisher clarifies that I should pursue arbitration on my own and gives a series of reasons why they want the case dismissed immediately. While he is saying this, the judge is looking at me directly as I gently shake my head and non-verbally plead to her to PLEASE SAY NO to his request. I bet my facial expression is communicating something like. "please don't abandon me now. Don't throw me to the wolves. They will devour me."

The judge denies that request stating that she will not make me pay another filing fee if I were to bring the case back to court to compel arbitration. She then says that she would like the two parties to appear in person in a couple of months to give her an update on arbitration. At this point, I am aware I lost this hearing because the demurrer was sustained but I feel relieved. I feel protected by the judicial system. I still have a chance to prove my case in arbitration and get the justice I'm seeking.

The judge then looks at me and asks what day we would like to come back. "In two months?.... what about.... St. Patrick's Day?"  I respond, "that date works for me, your Honor. " As we are ready to finish the hearing, the judge asks if there is anything additional from either party. Attorney Jason L. Fisher decides to open his mouth and make additional demands.

From this point on, I say NOTHING. I am just listening to Jason Fisher talk now. I feel I am watching a bizarre show. I am witnessing as Mr. Fisher picks up a shovel and starts to dig himself in a hole. "You Honor, we would like the case dismissed at this time."  The judge says that the case is stayed for now,  that the demurrer is sustained, that I will not be allowed to amend my complaint and that the case will be dismissed after arbitration is finalized. Attorney Jason Fisher repeats several times that he wants this case immediately dismissed so his client can have peace of mind and can put this behind him.  The judge reiterates that the case will be eventually dismissed. To what this attorney quickly responds that due to the dismissal, they will be asking for attorneys fees to be paid by Plaintiff (me).

Now the judge looks upset and says, "you're overreaching, counsel." Jason Fisher starts saying that there are REASONS why the opposing party is entitled to payment of attorney's fees. The judge interrupts, "not for any credible reasons that I know." Jason Fisher keeps on talking. I really don't understand why. He is already in a big hole.... and still digging, deeper and deeper.

It is so clear to me, and probably to everyone in this courtroom, that this attorney is expecting to get paid by me, not by Alfieri. Now I understand why his motions and responses are so ridiculously long. Of course they are! He has to justify the "exorbitant" amount of work he has put into this, so he can demand $70,000 -$80,000 in attorney's fees from me. He also wants to be "off" the case. That is why he is asking to have this case dismissed immediately.

Before the hearing is adjourned the judge states that we will be coming back to court on March 17th at 8:30 am, and that I will be allowed to AMEND my complaint if necessary.  That is, as I understand it, if Alfieri refuses to go to arbitration.  So in the end, this apparent loss has turned into a WIN.

There is truly no such thing as a "loss" or a "failure." I believe that when we apparently "fail" at something, we are simply being offered an opportunity - an opportunity to let go of what has not worked out for us, what we no longer need. It is also a turning point to choose a different path to explore exciting new possibilities. And sometimes, all we have to do is to not resist it and let it be. The situation might take a sharp turn, transforming that initial loss into a triumphant win.

Six Degrees of Separation

According to Wikipedia -
Six degrees of separation is the theory that everyone and everything is six or fewer steps away, by way of introduction, from any other person in the world, so that a chain of a "friend of friend" statements can be made to connect any two people in a maximum of six steps.
I could not agree more with this theory. In fact, I would not be surprised that new technology, social media networks and instant digital communication with even the most remote places worldwide, have resulted in a considerable decrease of that six-degree stretch.

Last week, I was trying to find an attorney in Rome to help me with my lawsuit. The film was shot in Italy and one of the defendants resides there. It made sense to me to get some legal guidance from someone who can navigate the Italian judicial system and who has handled cases such as mine... Maybe not exactly like mine, but cases that cross country borders.

I went to the Italian Embassy's website. The website provides a list of attorneys who are familiar and experienced with both the US and the Italian legal systems.  I wrote to all of them. Most of them replied immediately. A couple of them called me as soon as they read my message.

I have to admit that it was refreshing to talk and correspond via email with some of these Italian attorneys. They were very helpful and willing to listen. They were so animated when they talked... and that lovely Italian accent!

Because the attorneys I contacted were located in Rome, it was not so surprising that they knew of Calcata and have been there several times.  After all, it is just a 45 minute drive.  One of the lawyers said, "oh, Calcata, yes. I have been there many times. I go eat there often... beautiful place!"

I did not expect what was to happen when I googled two of the attorneys to whom I talked. I found their LinkedIn profiles. When I was about to request to connect with them, I realized that we already had over 100 connections in common.  This happened with both of the attorneys, not just one! Over 100 people in common! Who could ever imagine that!

Isn't it incredible how close we already are to people that we consider "strangers"?  Has it ever happened to you that you meet a person and when you request his/her friendship on Facebook, you realize you have at least one friend in common?... And this mutual friend lives in a different continent!

I believe that the theory of six degrees of separation is becoming increasingly evident. I would even dare to call it "six degrees of connectedness." If we had "imaginary" string and used it to individually connect to every single human being that we personally know... and if all these people were also to connect in the same manner to everyone they know, we would end up with a complex human network that covers the entire world, leaving nobody out.

It is just like our physical body. We have legs, arms, head, eyes, ears, nose, mouth, internal organs... that are somewhat independent but still part of a whole. It is the same with humanity although we sometimes seem to forget. So, let's reach out to our loved ones, our community, our nation, our neighboring countries.... and those who seem to be so far and unreachable. Remember that six degrees do not separate us... but connect us all. In reality, we could not be closer to one another... We are one.

The Service

What Is Service?

According to the official Los Angeles Superior Court website -
The law says that when you sue a person, partnership, corporation, or the government, you must give formal notice to the other side that you have started the legal process. In the same way, when you are already involved in a case and file papers with the court, you are required to give the other side notice of the paperwork you have filed. The legal way to give formal notice is to have the other side “served” with a copy of the paperwork that you have filed with the court. This is called “service of process.”
"Service of process" means that the other side must get copies of any paper you file with the court.  In “service of process” a third person (NOT you) is the one who actually delivers the paperwork to the other side.  The person who does this is called the “server” or “process server.”
Until the other side has been properly "served," the judge cannot make any permanent orders or judgments.
Process Servers can be: a friend/relative, county sheriff/marshal, professional process server, or anyone over 18 who is NOT part of the case. 







How I Got Him Served

After filing the complaint in court on April 15, 2014, I prepared copies to be delivered to Victor during the "service." Because I could not serve the papers myself and did not necessarily want to wait for the Sheriffs to deliver the papers to Victor, I got a couple of friends to help me with this task. I asked my dear friend Becky, who has worked as a professional process server in the past to act as the official server. She agreed. I also contacted my friend Alan, a talented young man with experience behind the camera, to be the videographer. 

Why a videographer? Mainly, to have proof of the service. Victor has come up with so many excuses and incredible tales in order to avoid responsibility or accountability. I did not want him to deny being "served" just as he denied ever having an intimate relationship with me.

I honestly thought that serving Victor would be much harder. I thought he would be evasive. It was much easier than anticipated. The service was done smoothly and without any complications.  







About the Video


The video was shot by my friend Alan and edited by me. Although the specific portion of the "service" is real footage, the rest was shot for entertainment purposes.  It is intended to simply poke fun at this whole situation, and specifically The Hairbrush Incident covered by TMZ Hairbrush Attack.  

Because Victor had been attacked with a hairbrush, it made sense that he would be in a better position to protect himself from future attacks if he had a hairbrush of his own. So we brought one for him as a gift... along with the summons and complaint.


A Brush With the LAW




Therese Borchard wrote in PsychCentral about how our bodies, minds and spirits begin to "mend" with a dose of humor:
  1. Humor combats fear.
  2. Humor comforts.
  3. Humor relaxes.
  4. Humor reduces pain.
  5. Humor boosts the immune system.
  6. Humor reduces stress.
  7. Humor spreads happiness.
  8. Humor cultivates optimism.
  9. Humor helps communication.

And I would add one more to this list...

       10.  Humor reminds us that what we are experiencing is simply a story.

We get to choose what type of story we want to live - a drama with non-stop suffering? An adventure full of unexpected turns and thrills?  A love story? A light-hearted comedy?  

Finding humor, especially in difficult or challenging situations, can bring so much healing and a better perspective of things.  Who said that life is supposed to be a struggle with loss and distress? Life is FUN. Let's enjoy the ride!

Above the Law

When I started my relationship with Victor Alfieri in 2010, he told me about all these different issues he had at that time. He was losing his California home, was getting very little work as an actor and had some debt. He showed me a court notice for a hearing to which he had to appear. It had to do with money that a credit card company was trying to collect from him.

He told me that he did not owe that money, that it was his ex-wife's debt, that she had maxed out their credit cards. I remember asking him what items had been purchased with the money owed. He pointed at his big screen tv, at the furniture. I smiled at him and said, "well, you have the items, why do you refuse to pay?" He was clearly angry and started saying that it was his ex who made the purchases, that he was not responsible. Although I believed that he should pay the balance owed, I offered to call the credit card company and/or collection agency to try to get to an agreement before the court appearance.

I did get him a $600-700 reduction. I even got them to agree to take monthly installments. I told Victor  the good news. He was not happy and said he would fight and ask the judge to order his ex-wife to pay for this debt. I asked Victor if he had gotten any other court notices. He said no.  "Everyone has the right to give their side of the story," I thought. However, I still believed he should have taken that offer.

I went to court with Victor. We were sitting in the last row of the small courtroom. He kept mocking people who were approaching the bench when their cases were called. I told him to be respectful because we were in a courtroom. Finally his case was called. He approached and stood in front of the judge.  I was surprised to hear the judge talking non-stop without giving Victor a chance to say one word. I heard the judge state that Victor had ignored all the court notices sent to him. The judge also said that Victor had been given the opportunity to respond and did not do so.

When Victor requested the opportunity to address the court, the judge loudly said, "you already had an opportunity before. Judgment in favor of plaintiff."

When we were walking out of the courthouse, Victor admitted to having received notices from the court and having ignored them, thinking they were not a big deal. I told him that when an issue is brought to civil court, it goes from the hands of the "private" parties and put in the hands of the court system.  Those notices were coming from the COURT, from a judge, I explained.

It is my opinion that Victor Alfieri believes he is above the law. He already used "the law" against me. His lawsuit contained slanderous claims about me. He used my own money to finance that lawsuit. He pocketed additional money from the budget. He finished the movie and has no intention of ever reimbursing me for my investment. And he still believes the "law" cannot touch him...  that I should "move on" and let him get away with what he did and continues doing.

I filed a complaint against him, his mother, Daniela Carloni and his two production companies on April 15th, 2014.  Alfieri was served on April 16th, 2014. See post "The Service"  for video. He has not filed an answer in court yet.  He has until May 16th to respond.

Because I have filed a "verified" complaint swearing under oath that all the statements contained in the submitted document are true and correct to the best of my knowledge, he also has to respond in a similar manner. He has to admit or deny each allegation (paragraph) of my verified complaint. And he also has to do it under oath.  It will be interesting to see his responses. I wonder if he would blatantly lie and deny facts or even statements the he, himself, previously gave under oath during his deposition.

Laws are created to govern our actions and behavior. Laws dictate what is "right" and what is "wrong," what is allowed and not allowed.  These laws are meant to protect our rights and wellbeing. In theory, laws are a great way to maintain balance and fairness. However, it is evident that there are flaws in every country's judicial system - Justice does not necessarily prevail every time.

There is an inherent "legal system" that rules human existence. It is our conscience - that inner voice that tells us when our behavior and actions are "right" or "wrong." We are our own judge. We are the toughest, least forgiving judge we will ever find. We know when we have done something that goes against our principles, morals and values. We know when we are hiding a dark truth. We are also the only ones who can ultimately forgive ourselves. That self-forgiveness can only be achieved if the "wrong" has been acknowledged and somehow rectified either with a sincere apology or proper amends for our actions. Everything can be forgiven - EVERYTHING - as long as we can regain our inner balance and peace through honest, kind, compassionate and generous actions towards others and ourselves.

Standing Up for the Truth

About one month ago, when I wrote my last post "Social Media," I was also writing something else... No, it was not my book. It was something that required lots of research and guidance from experts in the field.  It needed to follow a clear narrative with accurate facts and precise details. I spent about a week doing research and three days drafting this document. When I was done writing it, I could not believe it. I looked at my "masterpiece." I was proud of it. It was like one of those school projects - an essay, midterm or.... final paper that we need to complete in order to move forward to the "next level."

I still remember the day I finished it. It was a Thursday. It was March 20th. I had talked to a friend earlier that day. We were planning on going to a screening. I was almost done getting ready. I did my hair, my make-up, put on a nice dress and shoes... I was so happy to be done with my "writing project" and also excited to go out and celebrate that big accomplishment. As I was about to take a step back to check how I looked in the mirror, my body lost its balance. I felt as my right knee was giving in. It dislocated and twisted as I fell to the ground. The injury was major, considering that I was just standing and not making any drastic movements. It was so bad that I will be having surgery in a couple of days.

I probably overestimated what my physical body could endure. Sitting in front of the computer for hours with very little breaks cannot be good for anyone. I had also been working long hours on other projects related to my company. I had pushed myself to the limit - literally to the limit of what my physical body could take.

I was moving too fast, in such a big rush to get things done that I forgot to maintain my balance... my emotional and spiritual balance. This was reflected in my loss of physical equilibrium. A friend of mine said to me, "maybe it is the Universe telling you to slow down." It makes sense now. My "rushing" -  my impatience to speed things up reduced my awareness and prevented me from staying in the moment... in the NOW.

When this incident occurred, I thought that the injury I sustained would be a challenging obstacle that would inevitably delay any plans or projects I had at that time.  I was very upset and frustrated. I felt helpless. However, something amazing happened. Because this incident forced me to slow down, I came to truly appreciate my physical body. Our bodies are certainly a "gift" that we should never take for granted. I also had the time to review my "written project" and to make a firm decision as what I would do with it.

I have talked and written a lot about what my experience was like during this whole Trevino-Alfieri Saga. I have always stressed the importance of "Speaking Up" while doing it with integrity and honesty.  So I decided to speak up... this time, not only through the lines I write on this blog, but in a more formal and "official" way.

The written project I mentioned above is the official complaint for my new lawsuit against Victor Alfieri. In the early morning of April 15, 2014, I went to the Los Angeles Superior Court and filed my complaint against Victor Alfieri, Daniela Carloni (Victor's mother), Bondolini Productions and Black Knight Entertainment. The causes of action are: 1) Fraud in the Inducement; 2) Breach of Contract; 3) Breach of the Implied Covenant of Good Faith and Fair Dealing; 4) Breach of Fiduciary Duty; 5) Constructive Fraud; 6) Conversion; and 7) Accounting.  Case BC542748

Although I will be consulting with legal counsel on how to proceed, what papers to file and to give me general guidance, this time I am going "pro se," without an attorney. Why am I representing myself? For the simple reason that I do not have the funds to hire counsel. Even if I had the funds - the legal fees to litigate this case would exceed any judgment I might receive.

So just because I do not have the funds to hire an attorney, does that mean that I have no legal recourse?  No!  I do have the right to have my case heard by a judge and/or jury. Because the statute of limitations is applicable to any cause of action, I had to make a firm decision to move forward in a timely manner. I am happy with my decision. I am aware of the implications of this legal path I have chosen. I am ready to move forward and stand for MY TRUTH.

Life has taught me that we are not alone in this world and that it is OK to reach out. I can invite others to take an active part in my personal dream - "my story."  Their participation in my story, however, will be limited. I am the only one who has ultimate control of my life. It is not fair to expect others to make major decisions for me and then get upset or blame them when things don't go as I expected. By taking full responsibility for how I have dealt with what has happened to me in the past, I am able to stand up in the present with full conviction that I am in charge of my life.

And as don Miguel Ruiz tells us, "if we don't like our story, we are the authors; we can change it." I have made a big decision with complete awareness of the path I have decided to take. I am sitting in the driver's seat, behind the wheel... I have just made a sharp turn... What an exciting journey life is!

Being Brave

Last night a male friend of mine said to me that having all these details of my relationship with Victor over the internet was a big "turn off." His advice to me was not to talk about it. "And these lawsuits..." he started saying, "I did not start any of this" I interrupted. And not to talk about it??? It was not a choice for me anymore. My reputation and business were greatly damaged because of this. I had to clear my name somehow.

This friend then said, "you must have done something to make him do what he did to you." I don't believe I am responsible for Victor's actions. However, I would have to agree with my friend to some degree. This "Trevino-Alfieri Story" would have not happened if I had not stayed in a relationship with Victor - a relationship as a lover, friend or business partner. I chose to stay. I chose to trust him. I chose to invest in his film. I chose not to speak up when I disagreed. I always had a choice... And I certainly made a choice every time.

I finally feel that I am starting to recover from this whole experience. I believe I have come a long way. But, why am I so hurt by my friend's words?... So what am I supposed to do now? Should I take down this blog? Should I stop writing my book? Should I go curl up in a corner and swallow my truth? Should I shove this whole experience (the good and the bad) into a dark closet where "shameful" stories are to be hidden?

No! I have chosen to be brave and speak up. As to being courageous and honest, my friend Jane told me of a very popular song that addresses these two qualities. The song is "Brave" by Sara Bareilles. "Nothing's gonna hurt you the way that words do when they settle beneath your skin, kept on the inside and no sunlight. Sometimes the shadow wins. But I wonder what would happen if you say what you wanna say and let the words fall out. Honestly, I wanna see you be brave."

The lyrics to this great song speak to me loudly, just as I imagine they do to many other people. "Don't run, stop holding your tongue. Maybe there's a way out of the cage where you live. Maybe one of these days you can let the light in. Show me how big your brave is."

And the song goes on to say, "And since your history of silence won't do you any good. Did you think it would? Let your words be anything but empty. Why don't you tell them the truth?"

So I told my truth!!! And I continue sharing it with anyone who cares to read my words. Some will understand me a little better and will feel empathy. Some will be critical and will judge me. Others will get triggered or annoyed with my story and its details. Some might even take it personally... And maybe some will feel deeply touched and inspired to stop hiding and speak up their own truth.

The Dark Closet

Back in October 2011, I set up google alerts so I could be notified if there were new links with Victor Alfieri's name. I did this so I could be prepared in case he leaked more information about "the scandal" to the media. It is surprising that I rarely receive alerts. In fact, none of my links from this blog has triggered any google alerts.

A couple of days ago I received an interesting one... "Is Victor Alfieri Gay? -AllPeopleSay." Here's the link. AllPeopleSay.com. Reading it made me think of such possibility. Has he been keeping dark secrets in the closet? I started to wonder. Do all of his sexually charged jokes toward other males hold a repressed truth?

This article made me think of Victor and his odd sense of "sexual" humor. And as he stated himself during his deposition, "I'm Italian. That's the way we joke. And I like to joke like that." See "Sexual Harassment". If I were to learn that he is indeed gay, I would probably feel much more compassion toward him. His odd, erratic and vindictive behavior would be somehow "justified" by his continuous effort to cover a truth that might be too difficult to face... and to publicly share.

But does it matter what his true sexual orientation is? Does it really matter what anybody's sexual preference is?? It does not make a difference - at least not to me. It is just as if we were judged based on our choosing vanilla over chocolate ice cream.

I am not the type of person who judges others' sexuality. I believe we should all be free to make our own choices. I have many friends who are gay and love them dearly. They explain to me that being gay is not really a choice, that it is something with which they are born... A few of my gay friends have told me that they would choose to be straight if they truly had the choice.

I can only imagine how challenging it must be to try to live a life that is "acceptable" by the majority even if it goes against our own selves. Is it really easier to simply hide all those personal beliefs, preferences, opinions that are not accepted by others?

Just as we sometimes hide things in "junk drawers." We pretend that what these drawers contain actually doesn't exist and believe that by keeping their contents hidden, they will miraculously disappear.  When a guest comes to our home and opens one of those junk drawers, it might be uncomfortable. We don't really want to show that part of us. And on the other hand, we might have even forgotten what we put in there.

Something similar happens with "dark" and repressed secrets. We hide them and push them down trying to bury them. But although seemingly dormant, they grow stronger the more we try to conceal them. We might not even be aware that we are repressing them.

Two years ago, I bought into the belief that what happened to me - what I now call the Trevino-Alfieri Story - was shameful, that I should not discuss or tell anybody about it. Telling my story has been the most effective way for me to MOVE ON and to feel increasingly detached from the events that once hurt me so much.  It would be so much easier for Alfieri if he could do the same thing... if he were able to face those secrets he has been hiding in the dark closet and stopped creating "tales" to cover them.

The degree of shame associated with a "dark" secret is directly related to the effort invested in concealing or disguising it. It makes sense, of course. If it is something of which we are ashamed, we will try to hide it. But, what happens if we stop hiding it? What if we accept it and let it be? I personally believe that there is nothing too dark or shameful that needs to be locked out in a dark closet. As we practice self-acceptance and self-forgiveness, we become more accepting of others as well.

IMDb - "the world's most popular and authoritative source for movie, TV and celebrity content."

I remember what a big deal Victor would make about being listed and having credits on IMDb. He would quickly check anybody's name there. He would say that if it was not listed on IMDb, then it was not legitimate film or tv work. When I would come to his apartment to visit him, I would often see him checking his profile on IMDb. I also remember that he would regularly post his personal IMDb link on his facebook wall to have people click on it and increase his popularity rank.

The movie "Looking for Clarissa" is finally listed on IMDb. Here's the link imdb - looking for clarissa. And here's my own IMDb page IMDb - Adriana Trevino.  It is strange that I was not notified of this. Alfieri's personal assistant must be too busy to keep me informed of such developments.

At least I now know that Alfieri has the intention to distribute the movie. He is probably very proud of himself and believes he is finally a filmmaker. I have my own opinion. I will reserve it for now... What I can say is that my opinion of Alfieri as a filmmaker is directly related to his behavior and actions. An egocentric person who believes he does not need anybody's input, will act in a similar way when working as a filmmaker. A person who deceives, lies, manipulates on a personal level will do the same in any business endeavor of which he becomes part.

Making a film requires the work, input and collaboration of many. It is truly a group effort. Everyone's role is essential, as every organ and cell in our body is necessary to keep us healthy, complete... and alive.

I have learned that we are not meant to travel in this life on our own. We are meant to share our journey with others. Our actions, even if apparently insignificant, affect the whole universe, as we are all connected.  It is a fact that if we want to create something, we need to reach out. An experience, a goal, a dream can only become real if it is shared with others.

Financing a Dream

Independent Filmmaking

I still remember the day I read the financing agreement. The contract was clearly one sided and favored Victor in every single way. He would get my money to pay for the production of the movie. He would also be paid about 25% of the total budget for his "services." I would be risking my life savings and would not get anything in return if the film failed or did not reach completion. I am not stupid and knew that the contract was not fair at all. Why wouldn't I take over the rights to the film if Victor breached the contract? I am the one financing it, right?  I remember jokingly telling him. "Wow, this is such a one-sided contract. You are not going to stab me in the back, are you?"  He quickly responded without looking at me, "of course not. I would never do that to you. I love you, baby."

After he responded to me, something felt really wrong. I felt a sharp pain in my stomach. I ignored it while I talked myself into this "generous act" I was doing for the man I loved....  and failed to hear my own inner truth.

Alfieri took advantage of my lack of experience in filmmaking. He led me to believe that I would virtually have no rights even though I was the sole financier of the film. The person with the money should have control and ownership, right? But that is not what Alfieri believes. He claimed to be entitled to my money, to all production decisions and to the rights over the film.

Almost three years after I signed that financing agreement with Alfieri and Bondolini Productions, I have acquired much more experience in independent filmmaking. I have learned that the toughest obstacle to overcome is the financing of the film. I have worked with production teams in raising funds and attracting investors.

These great teams with which I have worked, have been really appreciative and grateful for my contribution to the film. These films have great scripts and wonderful actors already attached to the projects. But why aren't some of these films in production already? Because the complete budget has not been raised.

This was not the case for Victor Alfieri. I gave him the greatest gift any independent filmmaker could ever wish for - I financed his dream!




How Did Alfieri Pay Me Back?

He took my money and did not thank me once. In fact, he acted as if he were doing me a favor by "allowing" me to invest in his great masterpiece. He eventually took what was left of my money and used it to hire and attorney to sue me.

The "traumatic" experience financing and producing "Looking for Clarissa" (formerly "Looking for Clara") turned my whole existence upside down. There were so many false statements about me made by Alfieri all over the internet. The assumptions people were making about me were harming my personal and professional life while tarnishing my reputation. I felt I had no other choice but to give my side of the story.  I became brave to speak my truth.

Just right before the Trevino-Alfieri story started, I used to be so afraid to speak up if it involved "telling on" somebody or  simply disagreeing with someone else's opinion. I wanted to be liked and accepted by everyone.

I have finally learned that my former people-pleasing attitude does not serve me any longer. It does not serve me, or anybody else, for that matter.  Who wants to hear lies or "sugar coated" truths? Some might say that they prefer to hear "white" lies instead of something hurtful. Is this actually true? If we search deep inside of us, we will find the answer... We are always looking for the truth. Being ready and able to face other people's and our own truth... That is a different story.

So do we bluntly state our likes and dislikes? There are always multiple ways to say the same thing without lying. There is nothing wrong with being polite and considerate towards others when communicating. In fact, that is the way I choose to live my life. But, there is a line that, when crossed, blurs our sense of self-respect and integrity.

How do we know we are crossing that line?  We ALWAYS know. It is that feeling in your gut - a sudden blow to the stomach, alerting you that you are stepping into a situation that goes against yourself, a situation that will throw you off balance. This experience certainly knocked me to the ground. Two years have passed... I have gotten up. I am standing strong in my truth, facing the present with honesty and looking forward to the future.

Final Cut

About three weeks ago I received a DVD with the final cut of the movie I financed. I watched it right away with a good friend of mine who happened to be visiting me.  I was so happy to finally have the chance to enjoy the long awaited completed product.  Later that day, I brought the movie over to another friend's home. I watched it again with 3 more people.

Just a couple of days later I traveled to Mexico and brought the movie with me. The reason I brought it with me was that I needed re-watch it and write down comments and suggestions for the "talented" director, Alfieri.

My sister Karla expressed her excitement to see it. She could not believe that the movie - the subject of so much scandal and drama - was in fact completed. We both sat down and watched it.

I am reserving my comments and opinion for now. I will not share what others thought of the movie either.  I do promise that I will be updating this specific post when the time is right. I will share my opinion and feelings about the "final cut" I received.

What I can share right now is this:

  • This movie is 100% Alfieri. It is clear that Alfieri did not listen or consider anybody else's input when having the movie edited and completed.  
  • This movie shows Alfieri's talent at its best - as a writer, director and producer.
  • This movie is proof of how much Alfieri has to offer to the filmmaking industry.

Due to the great shock of my watching this masterpiece three times, I got physically ill and was in bed for several days. I was not able to write detailed comments and suggestions until just a couple of days ago. As soon as I emailed my comments to Alfieri's personal assistant, I received a response informing me that they had gone ahead with the final sound mixing and completion of the movie without considering any of my comments. They claimed that I was 4 days too late. I was supposed to submit my feedback within 2 weeks after receiving the final cut.

Why wouldn't they wait for my feedback? I am the financier of this independent film! Now they claim they want to "follow the guidelines" of the agreement I signed with Alfieri and Bondolini Productions. How convenient, right?  Bottom line is, Alfieri wouldn't have considered any of my feedback anyway. So, this independent film is 100% Alfieri made. It is the product of Alfieri's limitless creativity and directorial talent.
