Turning a Loss into a Win

About three weeks ago, I had a Case Management Conference hearing. During that hearing we were to deal with the Demurrer filed by Victor's attorney, and Motion to Strike portions of my Complaint. Jason Fisher, Alfieri's attorney, had changed the date from January 29th to January 22nd, a week earlier, giving me very little time to file my opposition to his two motions filed on December 12, 2014.  I had  until January 8th - only 26 days to respond. And these 26 days included 14 days I spent in Mexico during the holidays. So basically, I had a little over one week to prepare my opposition and what I was to present and say in court.

It is true that I am representing myself in this case. Hiring an attorney would cost me a fortune. I have  fortunately managed to pay some money to an attorney to prepare and go over the complaint and the opposition to the demurrer. I also asked a friend of mine who is also an attorney and a former judge to give me advise on how to address the court. He told me that he presided hundreds of hearings. He added that, because I was representing myself, it was important to show myself as a "human being."   He helped me prepare the following "speech."

Your Honor,
I am aware this court handles many cases of greater importance and significance than mine. I feel fortunate to be here in front of you at this time to address the motion filed which is to challenge any defects of my complaint and the issue of subject matter jurisdiction. 
Your Honor, my amended complaint sets out facts that are consistent with the causes of action and furthermore are alleged in accordance with the California Civil Procedure Code. I've listed the elements of each cause of action and drafted the complaint in accordance, eliminating any uncertainty or ambiguity.  There is particularity and specificity with respect to all claims, and all provide sufficient information as to clearly state a cause of action. 
Victor Alfieri and Bondolini Productions filed a lawsuit against me based on the production financing agreement and I ask the court to find that defendants have waived their right to arbitration. 
Your Honor, I am here today without counsel because Victor Alfieri has taken my life's savings of  $150,000. That was all the money I had in the world. He took the last $17,500 of my money to hire counsel to sue me. 
Your Honor, I know of nowhere to turn except to this court -- so I might, during discovery, bring all the proof needed to demonstrate fraud beyond clear and convincing evidence and that the money taken from me was for defendant’s personal use. 
As the pleadings allege, Victor Alfieri started a romantic relationship with me for no other reason than to secure my life's savings. He claimed to love me and further claimed that starting a production company as partners, would be a way that would allow the two of us to grow in our relationship and assure financial stability for the rest of our lives. 
Defendant never had any ambition of owning a production company or producing a movie. Most all of my money was used for Victor’s personal benefit. 
After giving Victor my life's savings, which he assured was all that he needed -- as it is also reflected in the contract -- he later writes and tells me he needs another $131,000 stating, "no money, no movie.” 
Your Honor, if the court requires I amend the pleadings, I will comply. However, your Honor, I ask that you allow me the opportunity to go forward with this case so that I can collect the necessary evidence and prevail.  He took every dime I had, your honor, and Victor has a pattern of this sort of behavior. 


So the day arrives. I ask my friend Christine to go to court with me. We arrive very early and check in.  I am nervous. I have been to court hundreds of times -- literally HUNDREDS of times --  but as a certified court interpreter, not a plaintiff in PRO PER.

Christine's presence calms me down. She tells me that everything will be okay. I then close my eyes and think of what Marianne Williamson always tells us to do in stressful and challenging situations such as this -- "Before you enter, blast everyone in the room with love."

We sit in the courtroom while all the other cases are called. I get to see how pleasant and fair the judge is to the other parties when handling their cases.  I am feeling much better. My case finally gets called. I approach and sit at a table facing the judge. Attorney Jason Fisher, is to my right. He does not even dare to look at me directly.

I have met and worked with over one thousand attorneys. This is not an exaggeration - over one thousand. And I can assert that Jason L. Fisher is the rudest lawyer I have ever met in my entire life. He refused to shake my hand when I extended it to him the first time we met in person. He does not respond to my emails or phone calls. So I am not surprised with how things unfolded during this hearing.

The judge states that her tentative ruling is to sustain the demurrer and send the case to arbitration. She then starts reading each cause of action, giving a reason why the demurrer is sustained. "As to Cause of Action 1, Fraud in the Inducement... it lacks... does not state specific... demurrer is sustained. As to Cause of Action 2... Cause of Action 3... 4... 5... 6... 7... demurrer is sustained."


I cannot believe that none of the causes survived the "demurrer" since the complaint and opposition to the demurrer were drafted and reviewed by several attorneys. None of the causes of action is properly pled???!!!  But what is more surprising to me is how calm I am. I feel this inner peace and stillness that is hard to explain.

The judge looks at us and asks if there is something we would like to say. Jason Fisher is quiet and looking down avoiding the judge's eyes. I say, "I don't know if he wants to say something first," referring to opposing counsel. The judge quickly answers, "he does not have to say anything. He won. You lost... So anything you want to say?"

At this point I am just looking at the piece of paper with my prepared speech. I cannot really read that now. I just lost, as the judge clearly stated. I do address the court and state that the first cause of action, Fraud in the Inducement goes beyond the contract containing the arbitration clause. I say something like this , "there was an agreement and promise made by Alfieri to start a production company together in July 2010. We were planning on making several movies. The first movie was 'Arturo Bond,' whose main character is Arturo Bondolini - that's why the name, Bondolini Productions. I invested money in that movie project first. By September 2010, I had already invested $60,000 into that specific movie - seven months before the production financing agreement with the arbitration clause was signed.  We did not produce "Arturo Bond," but decided to make a different film, 'Phoenix.' This film was not produced either. We then decided to make 'Looking for Clarissa.'  The false promise I am talking about is the production company. I was induced to invest in this last movie based on the false promise of a production company."

The judge looks interested in what I am saying. She says, "where is that stated in your complaint?" I read a couple of paragraphs from my amended complaint that do not cover what I am trying to convey. Because I was told by several attorneys to shorten my original 42 page complaint, my amended complaint does not have that specific information and dates that now I desperately need.

The judge then asks, "what is the reason why you don't want to go to arbitration?" I politely answer, "because it is my understanding that fraud allegations cannot be handled in arbitration." To what she responds, "that is not true. Fraud is handled in arbitration" just as it is handled in court. My eyes light up, "really?" I say with an evident tone of surprise in my voice. "She then goes to explain how arbitration works, that some arbitrators are former judges, that we get to choose our arbitrator.

Mr. Fisher says that he told me about arbitration over the phone, making it sound that he had been polite and tried to settle this before filing all those motions - which is a complete lie. In fact, that initial phone call was the ONLY conversation we had and it sounded to me more like "this is war" than anything else.

Attorney Jason Fisher starts going on and on about my refusal to go to arbitration, about the -- as he puts it -- "exorbitant" number of hours he put into writing those motions. Again, trying to make me look like an unreasonable person who filed this complaint with malice and in bad faith.

The judge points out that it is understandable I would not believe what he was telling me as he is the opposing attorney. Why would I trust him? Why would I follow any legal advise he could offer? Then she looks at me with so much compassion in her eyes and asks me, "why are you so scared to go to arbitration?" I say, "because for the first cause of action, Fraud in the Inducement, I could be awarded punitive damages - something that cannot be considered in arbitration."

The judge is now looking at me directly, being as impartial as required by her position but unable to hide her kindness and concern. "Don't be scared. All those things will be dealt with in arbitration." She adds that arbitration is pretty much like trials in court, but much more informal.

The judge looks satisfied that the case will be taken to arbitration. She then says that the case will be stayed, both parties will stipulate to arbitration, and that the case will be dismissed after arbitration is completed. Attorney Jason Fisher states that they will not agree to that stipulation, "Isn't arbitration what you wanted, counsel?" the judge asks puzzled. Mr. Fisher clarifies that I should pursue arbitration on my own and gives a series of reasons why they want the case dismissed immediately. While he is saying this, the judge is looking at me directly as I gently shake my head and non-verbally plead to her to PLEASE SAY NO to his request. I bet my facial expression is communicating something like. "please don't abandon me now. Don't throw me to the wolves. They will devour me."

The judge denies that request stating that she will not make me pay another filing fee if I were to bring the case back to court to compel arbitration. She then says that she would like the two parties to appear in person in a couple of months to give her an update on arbitration. At this point, I am aware I lost this hearing because the demurrer was sustained but I feel relieved. I feel protected by the judicial system. I still have a chance to prove my case in arbitration and get the justice I'm seeking.

The judge then looks at me and asks what day we would like to come back. "In two months?.... what about.... St. Patrick's Day?"  I respond, "that date works for me, your Honor. " As we are ready to finish the hearing, the judge asks if there is anything additional from either party. Attorney Jason L. Fisher decides to open his mouth and make additional demands.

From this point on, I say NOTHING. I am just listening to Jason Fisher talk now. I feel I am watching a bizarre show. I am witnessing as Mr. Fisher picks up a shovel and starts to dig himself in a hole. "You Honor, we would like the case dismissed at this time."  The judge says that the case is stayed for now,  that the demurrer is sustained, that I will not be allowed to amend my complaint and that the case will be dismissed after arbitration is finalized. Attorney Jason Fisher repeats several times that he wants this case immediately dismissed so his client can have peace of mind and can put this behind him.  The judge reiterates that the case will be eventually dismissed. To what this attorney quickly responds that due to the dismissal, they will be asking for attorneys fees to be paid by Plaintiff (me).

Now the judge looks upset and says, "you're overreaching, counsel." Jason Fisher starts saying that there are REASONS why the opposing party is entitled to payment of attorney's fees. The judge interrupts, "not for any credible reasons that I know." Jason Fisher keeps on talking. I really don't understand why. He is already in a big hole.... and still digging, deeper and deeper.

It is so clear to me, and probably to everyone in this courtroom, that this attorney is expecting to get paid by me, not by Alfieri. Now I understand why his motions and responses are so ridiculously long. Of course they are! He has to justify the "exorbitant" amount of work he has put into this, so he can demand $70,000 -$80,000 in attorney's fees from me. He also wants to be "off" the case. That is why he is asking to have this case dismissed immediately.

Before the hearing is adjourned the judge states that we will be coming back to court on March 17th at 8:30 am, and that I will be allowed to AMEND my complaint if necessary.  That is, as I understand it, if Alfieri refuses to go to arbitration.  So in the end, this apparent loss has turned into a WIN.

There is truly no such thing as a "loss" or a "failure." I believe that when we apparently "fail" at something, we are simply being offered an opportunity - an opportunity to let go of what has not worked out for us, what we no longer need. It is also a turning point to choose a different path to explore exciting new possibilities. And sometimes, all we have to do is to not resist it and let it be. The situation might take a sharp turn, transforming that initial loss into a triumphant win.

Is Any Publicity GOOD Publicity?

TMZ Reported...

"Bold and the Beautiful" star Victor Alfieri is safe from future attack ... because the man he accused of assaulting him with a hair brush has been ordered to stay out of his hair ... TMZ has learned.

We broke the story ...  Alfieri had a close shave last month ... claiming his neighbor, xxx,  hit him in the face with a hairbrush. The soap star claims xxx has been hair-rassing him for more than a year.

Alfieri says he can't escape the guy ... because they live in the same building.

The judge just ordered xxx to stay 100 yards clear of Alfieri... except when they're in their building at the same time.



WHO WANTS THIS TYPE OF PUBLICITY?

None of the comments posted in response to this TMZ Article is kind to Victor.  I genuinely feel bad for him. I am not sure he intended to have this become so public. Why would anyone want this all over the internet?

I will not make any comment about this TMZ piece. Let's just hope Victor keeps safe and away from xxx. Or should I say? I hope his neighbor keeps safe and stays away from Victor.

Personal Assistants - People We Trust

This post is dedicated to Alfieri's PAs: C.R. and the "temp."

I first heard from C.R. on January 8, 2013 when Alfieri and I stopped communicating.  C.R. introduced herself or himself as Alfieri's PA (either Production Assistant or Personal Assistant) and offered to meet me in person to deliver the latest cut of the movie. We agreed to meet on Saturday, January 12th at 3 pm at the Coffee Bean on Sunset Blvd.

I was curious to meet Victor's assistant. When I arrived at the Coffee Bean, there was a young man waiting for me there. I asked if he was the assistant but he told me. "I am Victor's friend." To what I responded, "Oh, I'm sorry..." I really meant it. I was sorry that he was Victor's friend, as this young guy seemed to be a good person.... unaware of what type of person Alfieri really is.   I thought that I sounded rude so I added, "I am sorry I am a few minutes late."

This C.R. person continued communicating with me until July of this year. After that, this PA, C.R. did not sign off any of the emails.  Why? Because Alfieri has never had a PA. He is hiding behind an imaginary assistant to avoid confronting me. In a way, back then I didn't blame him for doing so. If that was the only way he felt safe to communicate with me, then that was ok. Young children also have their "imaginary" friends, don't they?

More recently, I confronted Alfieri and asked him to simply admit that there was no personal assistant. It seemed childish to continue playing that game. He completely ignored my words.

What Alfieri seems to forget is that I know his writing style too well. I know the way he structures his emails. I know how he underlines complete paragraphs typed in bold italics. Who does that???? The only person I know who does that is Alfieri.

Moreover, Alfieri's grammar and spelling mistakes are easy to spot. Because he is Italian, he has a hard time with the "s" and plural nouns.  He adds the "s' to nouns that generally are not written as plural, such as " chewing gum," "legal action," "documentation."  And it is not that it is horribly wrong, but it is clear that a native English speaker would not make such mistakes.

A Personal Assistant With Access to EVERYTHING!


During his deposition, Victor Alfieri claimed that I was his personal assistant. His personal assistant?  He claimed that I had access to his phone, his computer, his email.... access to everything!  The reason why he said that was because he had no way to explain the very personal text and email messages between the two of us. He refused to be held accountable for any message that would suggest we had an intimate relationship.

Didn't he accuse me of harassing him and of being a relentless "fan" obsessed with him?  So, if I were so obsessed with him, why would he trust me with his phone and computer?

Another version he gave during his deposition was that I was a VERY good friend, a friend who was always there for him. So, if we were such close friends, why would he accuse me of harassing him? Wouldn't a friend tell another friend about it??

None of his stories adds up. They actually contradict one another. He does deserve credit on the great effort he puts into creating this brilliant imaginative tales.

In a recent message that I sent to his "assistant," I confronted him.
Alfieri, why do you pretend to have a personal assistant? Like the personal assistant I was to you???? having access to your phone, computer, email and everything???? Be careful!!!! Your PA might get obsessed with you and start sending messages on your behalf... to herself (or himself)... or maybe there are 8 Alfieri impersonators still "out there."

It is my opinion that once he has created one of his "tales," Victor Alfieri cannot tell the truth. He starts believing his own lies. He immerses in his self-created fantasy. He even feels offended if you don't participate in it!

I decided to write this specific post about Personal Assistants because I do not want to pretend I don't see the truth.  I simply don't want to play this game with Alfieri anymore.

The past is in the past. Whatever happened to us cannot be changed. The only thing we can change is our attitude. Today we all have an opportunity to write a new story, a story based on truth and honesty.

Yesterday, my good friend, Roxane Davis forwarded to me the LinkedIn message below that she received from Victor.



It is good that Victor Alfieri has decided to be "professional" and expand his business network. He wants to reach out to all possible business contacts. Nothing wrong with that... However, what he seems to forget is that Roxane was Clark J. Gable's manager during the production of our movie and that his attorney, Roger Muse, threatened to sue her. Now he wants to connect?
Roxane's reply to this email was simply, "you're kidding, right?"

Alfieri's desire to expand his network did not stop there, he also sent a LinkedIn request to the movie co-director/chief editor. Her lawsuit against Victor is still pending... and he wants to also connect with her?

He probably did get AMNESIA and does not remember the he has burned bridges with so many people... He certainly burned the bridge with me and broke my trust.

Update on Post-Production

Alfieri has not kept me informed of the status of the movie. He claimed there were two new investors but has failed to provide their names, copies of their agreements and proof of investment.  He continues to breach our written agreement again.... and again.

Post-Production

On January 4th, 2013, Victor Alfieri stopped communicating with me and threatened to take legal "actions" (not action, but actions).

He now has a PA with the initials C.R. who is being communicating with me and giving me updates on post-production.

I know that this personal assistant is Victor himself or one of his girlfriends. How do I know? It is a coincidence that this PA has the same writing style as Victor and makes the same grammatical mistakes.

It really does not matter what the truth is. What matters is that Victor feels comfortable communicating through a third party - real or imaginary. At least, I am getting updates on what is going on.

He claims to have new investors but fails to provide any names or executed contracts/agreements. He simply writes what he is doing and refuses to listen to any of my concerns, feedback or suggestions. He claims to be "working together" to finish the film. This is unfortunately not true. He is merely keeping me informed of some of the things he is doing (without providing any proof whatsoever) while our contract clearly states that he needs my written authorization for ANY changes in the budget or terms of the financing agreement (including other investors etc).

This is the last email I received from his "assistant" on February 20, 2013.


Ms. Trevino:
We are pleased to inform you that Bondolini Productions, LLC has obtained additional financing for the Sound Mix and Mastering.  Bondolini proposed the same deal we made for the color correction investment ($5,000) and the new investor have accepted: both of these investments is $17,000 in the aggregate is pari passu with you, one E.P credit each, the standard 120% ROI on the investment but NO BACK END DEAL (no points). 
Bondolini has received $12,000.00 from the second investor yesterday, which rounds out this most current raise.  However, as stated above, the recent raise is completely accounted for at this time, but Bondolini has no money left to pay the remaining balance to the Editor, who has already rendered services. 
NOTE:Victor had to invest his money into LLC Franchise taxes for the year and accounting balance so the sound mix and mastering will be paid with the second investor's money. Sound Mix balance $10,000.00 and Mastering 1,900.00. Victor also forward $600.00 to the Editor lowering the new balance to $2,400. 
With respect to Bondolini's balance due to the Editor we have the following options: 
 a) you can come up with the remaining cash ($2,400.00) by next tuesday Feb 26 to pay him; OR 
 b)  Bondolini will include the Editor's balance-owed as part of the production cost, and deem the balance-owed as an investment in the production, and    make him one of the EPs with the same deal terms as stated above.   
Bondolini need an answer on which way you want to go by Friday at 5 pm PST.  Once we obtain the final cut, we will send it to you so you can review it. 

SOUND MIXING AND COLOR CORRECTION WILL START ON MARCH 4TH 2013 AND IT WILL END ON APRIL 29 2013.

I just replied to the previous email five minutes ago. My response was this:


C.R,
I do NOT agree to have the new investors get EP credits. I agreed to co-executive producer or associate producer credit. No more than that. Only people investing 50k or more should be considered for an EP credit.
I want the full names of these investors, their notarized executed agreements/contracts and proof of their investment.
I want proof of payment to editor. I want his name and a letter/receipt from him stating the total of the money he has received. I want the same from any other post-production person working on this project.
I do NOT agree to give the editor an EP credit for the 2,400 he is owed. He can get deferred payment with a 20%, second position. No EP or any other producer credit. 
I am aware of the importance to be clear with our communications since there is a binding contract that shall not be breached. So, this is why I am voicing the points with which I disagree.

Many might wonder why I bother to express my disagreement to the proposed points made by Alfieri. The reason is that I believe I should be clear with my communication and should not say I agree to something I do not. I am in this current position because I did not speak up when I should have. From now on, I will always act with integrity.

Let's hope this movie gets finished and gets distributed...

Sept 21, 2011

I knew that Victor had sued me the day before, on the 20th, when my attorney friend, the one who wrote the letter to Victor, called me and emailed me the complaint. When I saw it, I though it was completely ridiculous. In fact, I did not read it carefully, as it contained lie after lie and made no sense to me. I had not been personally served with papers, so I opted not to worry too much about it.

What I never expected is what happened on the 21st of September. I received an email from my good friend Jonathan.

I immediately clicked on the link. My jaw dropped as I read it. I started to wonder how Jonathan saw this link. Was he searching for me or Victor specifically? Why would he read this specific article? How much was on the web?

By Sunday, September 25, 2011, TMZ wrote an article that eventually traveled the world translated in several languages. I was shocked when one of my clients in law enforcement sent me a text message with the tmz link inquiring "do you know this guy?"

I read it, immediately talked to my attorney friend. She told me to respond and tell the truth. So that is what I did.

A super good looking soap opera stud claims he's being victimized by an obsessed female movie producer -- who allegedly has it out for him because he refused to email her a pic of his "live organ."

Victor Alfieri -- who starred on "The Bold and the Beautiful" and appeared in the movie "Angels and Demons" -- is also an aspiring filmmaker ... and claims a female fan decided to invest in one of his projects last year.

Alfieri claims the woman, Adriana Trevino, dumped more than $150k into his movie -- but it soon became clear that she wanted a sexual relationship with Alfieri as part of the package deal.

In his lawsuit, filed in L.A. County Superior Court, Alfieri claims Adriana would often try to get frisky with him -- one time suggesting they have sex to "release some stress."

Alfieri claims he turned her down ... so "she asked that he at least email her a picture of his 'c**k' which she could masturbate to."

Alfieri claims he again refused ... and instead emailed her a link to a photo of a dildo -- but Adriana replied that she would rather "have Alfieri's 'live' organ."

According to the suit, Adriana finally got the message ... but instead of quietly moving on, she allegedly stole the footage from Victor's movie ... and refuses to give it back.

AND THERE'S MORE ...

Victor claims Adriana contacted his mother who lives in Italy -- and told her that they were humping ... which in turn caused Victor's mom to FREAK OUT so bad, she needed to be hospitalized.

Victor is begging a judge to force Adriana to return his footage -- plus he wants unspecified monetary damages.

The producer who is being sued by soap star Victor Alfieri claims she was just joking when she asked him to send her a pic of his privates -- and says the two were in an "intimate relationship" until Alfieri broke it off and ran off with her money.

Adriana Trevino claims she began working with Alfieri on a movie in June 2010 and their relationship began around the same time. Trevino says Alfieri wanted to keep their relationship secret, which she did, until she heard that Alfieri was telling the crew of their movie that she was obsessed with him.

Trevino says she came clean about the relationship and as soon as she did ... she says Alfieri withdrew the rest of her investment in the movie from the bank. She says he disconnected his phone and disappeared.

As for his claims Trevino was somehow involved in landing his mom in the hospital, she says the mother and her were quite close. Trevino says she went to the mother when Alfieri disappeared, and when the mother tried and failed to get a hold of her son ... she had to be rushed to the hospital.

She explains the penis pic request ... saying Alfieri mentioned sending her a pic and she was merely asking for what she was offered.

Trevino says she's planning to sue for slander. 



By September 27, there were over one million links covering this scandal. I received emails and calls from magazines and reporters who wanted to get an interview with me and my side of the story. TMZ called me constantly to get more details so they could continue covering this "juicy" scandal. I refused to give any more information per my new attorney's advice.

Never in my life did I expect to be involved in a Hollywood scandal such as this. Now I wonder what would have happened if I had told the truth, the whole truth... everything... from the beginning. The scandal would have died right then...

And what if I had told the truth to the production cast and crew about my intimate relationship with Victor?... then all of this could have been avoided.

Why Did Victor Alfieri Dismiss the Lawsuit?

On September 20, 2011, Victor Alfieri filed a lawsuit against me. The lawsuit contained salacious and false allegations about me. He made sure to leak it to the media with the help of his skilled publicist.

I would have been happy if he had dismissed it before I filed my cross complaint on November 10, 2011.  I tried to come to an agreement with Victor.

Victor's first offer was - He would dismiss his lawsuit if I agreed to walk away from the project and give up the $150,000 I invested. This meant, I would never see my money, I would not get my Executive Producer credit... and my reputation would remain "tarnished" by the slanderous allegations he made about me.

Why would I accept that offer?  I had no choice but to continue with the legal battle. Victor continuously affirmed that he had NOT touched the $17,500, that the money had not been used.

The money were not to be "touched" for any reason while this dispute was pending.  I remember telling my attorney, "if he assures that he has not converted this money and used it, then it should not be a problem to return it to me."

The only financial issue at this point was the money (my investment) that he had taken without my authorization. The defamatory statements he made about me were a separate issue... I was willing to let go of that if I got the "disputed" funds back.

My offer to him was -  I would not file a cross-complaint against him if:
  1. Victor would return the $17,500 to me.
  2. Upon payment, I would participate in the joint public statement saying something along the lines of "there was an accounting dispute. It has now been resolved."
  3. The joint statement would also confirm that there was a consensual relationship of an intimate personal nature.
  4. I would not waive/release any claims

He, of course, refused to return any money or admit that he and I had been in an intimate relationship. On November 10, 2011, I filed my original cross-complaint (you can read it at the bottom of this post).

After going through so many different attorneys, by March 2012, we had not reached any settlement. It was clear that we were continuing this legal battle. At least at this point, I had insurance and was able to take my case to trial.

March 30, 2012, Alfieri dismissed his lawsuit against me out of "good faith"?  On April 2, 2012, my attorney writes an email to me:
"I called opposing counsel to inquire about the dismissal and was advised that they wanted to show you how serious they are to get the movie sold and or distributed. I was told that they have finished the movie and now want to sell it and want you to be involved with same."
Dismissed.... just like that!  This sounded suspicious to me.

A - When I find out that Ms. Trevino had an insurance policy so she had a free lawyer. You cannot fight a free lawyer. So I have to, like, dismiss my lawsuit in order to become even with her.

To become even with me????  In other words...to force me to "fund my own litigation" or... to give up.

Was I a Victim of Fraud?

UPDATE - 11-17-14  I believe I am a victim of Alfieri's FRAUD. That is why I filed a new complaint against him in April 2014. My case is proceeding and should be going to trial in 2015.

Update: As of 4-14-13, Victor Alfieri has not respected our agreement and continues to breach it. I learned that the money he took from me was used to sue me. I also recently confirmed that he was planning on suing me as soon as he took the rest of my investment - while I was trying to negotiate and work things out with him. He has refused to provide proof of new money invested and claims that he has been paying post-production crew with cashier's checks and cash - something that looks very suspicious.

FRAUD

Definition 
A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.
During the long twelve months litigating this case, my belief was that Victor Alfieri did not have the intention to finish this movie. It was my belief that fraud had been committed.

To my surprise, Victor handed me a DVD with the Director's Cut of "Looking for Clara."I admit that what I saw was much better than what I expected. The movie still needs some post-production work and should be completed in a few months.

Even though I am not in complete agreement with the way the production money was spent and handled, I am not claiming that fraud has been committed. If there is an actual movie produced, then my investment is legitimate.

My lawsuit has been dropped. I am not planning on legally pursuing fraud allegations against Bondolini Productions or Victor Alfieri in the future. I do want to see this movie completed, distributed and released.

Victor and I have agreed to work together to finish the film. It is unfortunate that "working together" for Victor means - He does as he pleases and makes all the decisions without considering any input from me.  Although I do NOT completely agree with the way he is handling post-production, I will not create obstacles that could prevent the release of this film.  Therefore, I will not write about fraud allegations during pre-production, production or post-production. I am not making any such claims at this time.

My personal relationship with Victor Alfieri is another story. There was certainly deceit and betrayal. It might sound like a tragic story. But believe me, this has been a profound learning experience. I feel fortunate to have reached a much higher level of awareness.

Through this blog I am releasing an old story that no longer serves me... in the process, I am also creating a new story for myself... one filled with integrity, respect, forgiveness and compassion.

It would be reasonable to believe that I dismissed my lawsuit against Victor Alfieri and Bondolini Productions because we reached a mutually agreeable settlement. That is not the case. This is what really happened...

Just a week after Victor and I were deposed we had our mediation scheduled. I did not want to mediate with Victor as he had told lie after lie during his deposition. I believed that the mediation would be a waste of money and time. Victor and his attorney Roger Muse were one hour late to the mediation. We were paying the mediator an hourly fee and I could not afford to spend extra time "mediating" especially if we were not going to get anywhere.

I will not discuss the particulars of that mediation because we promised to keep it confidential. I will respect that oath of confidentiality.  What I can say is that I believed that we had reached a resolution to have the movie completed and distributed and there were also promises of public statements to resolve some misunderstandings. What I did not know was that by settling in mediation I would be bound to "secrecy." I would not be able to ever talk about what happened.

I remember talking to my two attorneys about my concerns about the "tentative" settlement I had reached with Alfieri. They both confirmed with me that if I signed a settlement, one of the clauses would be to not take future legal action or to not publicly talk about this case or these facts again. I would be tying my own hands.

This settlement felt really wrong to me. I knew in my heart that by signing a settlement with Victor Alfieri I would be selling myself out.  I communicated this to my attorneys. What I heard from them shocked and scared me. They told me that if I did  not sign the settlement they could no longer represent me because it would be unethical and unprofessional. They explained to me that when we all shook hands after mediation, that was just as official as signing the agreement.

I was faced with these four options:
  1. Signing the settlement with Victor and tying my hands forever.
  2. Representing myself during the trial and the rest of the case - a very scary option.
  3. Hiring another attorney - not really an option, as I had no money left.
  4. Dismissing my lawsuit without signing any settlement.
At this point I was emotionally and physically exhausted. I did not want to fight any longer. On the other hand, I did not want to be forced to lie or cover the truth because I had a "settlement." So I decided to dismiss the lawsuit without signing any agreement with Victor. This way, at least, I would still have freedom of "speech."

So, why would I agree to a press release like this????
"I have dismissed my lawsuit against Victor Alfieri and I would like to publicly retract the fraud allegations I made.   These statements were made by me after having been misled by a third party.  Once Victor and I met to review the books and bank statements, it became evident that I had been lied to by this third party.
   No money was ever stolen. Victor Alfieri did not commit fraud. I have since had an opportunity to view the film and I am very pleased with the job Victor has done.  Since we have settled our dispute, Victor and I have agreed to continue working together to complete the film as originally planned." - Published on Dec 20, 2012.
